Share Certificate Name Change and Correction in Jharkhand

Shares are the last record on the list and the one where a wrong name costs money quietly: dividends returned by the bank, a dematerialisation request bounced on a name alert, a sale blocked, a transmission to heirs held up by an affidavit. Since SEBI's 2023 norms the process is the same everywhere and turns on one document, the PAN, and one form, ISR-1. Transfer versus name change. Since April 2019 a physical share cannot be transferred to a buyer; a transfer needs demat. A name change on your own folio is not a transfer and is still processed on paper. SEBI's Two Rules for a Name on Physical Securities: Minor Mismatch and Change of Name

SEBI's circular of 16 March 2023 on common and simplified norms for investor service requests, consolidated in the Master Circular for RTAs of 17 May 2023, sets out in its Annexure C what an RTA does with a name that does not match. It draws one line, and the whole cost of your case sits on one side of it or the other.

Minor mismatch: no instrument

  • Initials against a full name; a middle name present on one record and absent on the other; a small variation in spelling; a title or a suffix.
  • The RTA updates the folio on any one of the listed KYC documents showing the name as it should be, Aadhaar, passport, driving licence, voter ID, PAN, without an affidavit or a gazette.
  • This is the rule that covers most Jharkhand folios: "S. K. Mahto" against "Sunil Kumar Mahto", "Tirki" against "Tirkey", "Devi" dropped for a surname the PAN carries.

Change of name: a legal instrument

  • A different name, a surname taken on marriage, a maiden name resumed on divorce, a name chosen.
  • The RTA wants the instrument: the registered marriage certificate, the certified decree, or the Gazette of India notification, with PAN and Aadhaar already in the new name and the original certificate.
  • The certificate is reissued in the new name; the folio number stays.
The folio is not frozen, but nothing moves without KYC. SEBI withdrew the freezing of folios in November 2023, and from April 2024 an RTA does not process a service request, including a name request, on a folio whose PAN, bank details, address, contact and nomination or opt-out are not on record, and pays dividends only electronically. Form ISR-1 first, then the name.

Central Gazette Name Change Process From Jharkhand, Step by Step, Before the Share or Demat Update

For a chosen new name, an RTA and a depository participant want a legal instrument, and the Gazette of India is the one every RTA's checklist names. There is no Gazette office in Jharkhand and no State Gazette route; the file goes to the Department of Publication in Delhi in your own name. Reading the published notice for the RTA

The e-Gazette PDF carries the Gazette of India number, the Part IV heading, the date of publication, the page number and your notice in its own paragraph. The RTA and the DP read the number, the date and the page; write them on the Form ISR-1 covering letter. A notice with a misprint is corrected by corrigendum within six months, free where the press erred; a corrected notice is what the RTA gets.

Two proformas, two fees. A chosen new name is a change of name, "hitherto known as", commonly Rs 1,100. A name wrongly written on a certificate is a PUBLIC NOTICE quoting the misprint exactly, commonly Rs 1,350, on the public notice page. Sending one for the other's case returns the file and the fee is not refunded. For a share certificate the choice follows SEBI's rule: a misprint the RTA can treat as a minor mismatch needs no notice at all; a folio name that differs from your PAN in substance, and that you do not want to change your PAN to, is a public notice; a name you have chosen is a change of name.

PAN first, Aadhaar linked

The account's PAN must carry the name and be linked to Aadhaar; a demat account on an inoperative PAN was suspended in 2023 and SEBI's May 2024 review lets it transact only with the existing intermediary. Correct PAN, then link.

The KYC modification

The DP's KYC modification or account modification form, at the branch or in the app, with the proof for your reason, PAN and Aadhaar, and an in-person or video verification where the DP asks. The DP files the change with the KYC registration agency.

The depository and the KRA

NSDL or CDSL updates the account name; the KRA record updates, and every broker and fund house that reads it sees the new name. The holdings do not move.

The company and the bank

Dividends on demat holdings are paid to the bank account in the demat record, in the account name; update the bank first. Where a company's dividend advice still shows the old name, the RTA reads the beneficiary position from the depository at the record date and follows.

Dematerialisation and the Depositories' Name Alert: Correct the Certificate First

Under SEBI's 2019 direction on enhanced due diligence for dematerialisation, RTAs supply the depositories a database of physical holders, and NSDL and CDSL validate every dematerialisation request against it and raise an alert where the name on the certificate does not match. A Jharkhand family sending a certificate in "Hembram" to a demat account opened in "Hembrom" has the request bounced, not queried. The order that works is the RTA first, under the minor-mismatch rule where it applies, then the demat request form to the DP with the corrected certificate; or, where the certificate name is right and the demat account is wrong, the DP's KYC modification first.

Coal India, SAIL and Tata Steel Employee Holdings in Jharkhand: The Folios That Fill the State's Registers

Jharkhand's largest population of individual shareholders came into the market through their employers: Coal India's 2010 public offer with its employee quota across CCL, BCCL and ECL; SAIL's offers for Bokaro Steel Plant staff; Tata Steel's employee schemes in Jamshedpur; and the public sector banks' offers to their own staff. Many of those folios were opened in the name the employer's records carried in that year, with initials, a Kumari or a Devi, or a tribal surname in the payroll's spelling, and have never been matched to a PAN that was corrected since. The employer's own name record is a separate matter, on the gazette page's departmental deed section; the folio follows PAN and SEBI's rules, and is usually a minor-mismatch correction on ISR-1 rather than a Gazette case.

What a Name Mismatch Does to Dividends, a Sale and a Transmission

Dividends

Paid electronically to the bank account on the folio or the demat record, in the name on record. A bank returns a credit whose beneficiary name does not match, and the company parks it as unpaid; after seven years unclaimed dividends and the shares themselves move to the Investor Education and Protection Fund, and getting them back is a separate claim.

A sale

A physical share cannot be sold until dematerialised, and a dematerialisation request in a mismatched name is bounced. A demat sale needs the account KYC in order; an inoperative PAN or a KYC hold blocks the debit.

Transmission to heirs

The heirs prove that the holder under the folio name is the deceased under the death certificate name. With the Gazette or certificate kept with the holding, the transmission forms move; without it, an affidavit, an indemnity and months. A name change is never a route to transmission; the RTA's transmission process is.

Share Certificate Name Change and Correction in Jharkhand: Frequently Asked Questions

How do I change my name on a share certificate in Jharkhand?+
Correct PAN first, register the folio's KYC on Form ISR-1 with the company's RTA, then send the RTA's name request with the original certificate, PAN, Aadhaar and the proof for your reason: any one KYC document for a minor mismatch under SEBI's 2023 norms, or the marriage certificate, the decree or the Gazette of India for a change of name. The RTA reissues the certificate in the new name under the same folio, commonly within 15 to 30 working days.
Are my shares physical or demat, and why does it matter?+
A paper certificate with a folio and certificate number is physical, and the request goes to the company's RTA; a holding shown on a depository statement with a DP ID and client ID is demat, and the request goes to your depository participant. Physical takes longer and ends in a reissued certificate; demat is a KYC modification with nothing reprinted.
Do I need a gazette to correct initials or a spelling on my shares?+
No. SEBI's circular of 16 March 2023 treats initials against a full name, a missing middle name and a small spelling variation as a minor mismatch, corrected by the RTA on any one KYC document such as Aadhaar or PAN, without an affidavit or a gazette. The Gazette of India is for a change of name, along with the marriage certificate or the decree for those cases.
What is Form ISR-1 and why must it come first?+
SEBI's form for registering or updating PAN, bank details, address, contact and the folio numbers on physical holdings. Since April 2024 an RTA does not process any service request, including a name request, on a folio whose KYC is incomplete, and pays dividends only electronically; the folio is no longer frozen but nothing moves. File ISR-1, then the name.
Can I still correct the name on physical shares after the 2019 transfer ban?+
Yes. The 2019 rule bars transferring physical shares to a buyer; a name change or correction on your own folio is not a transfer and is processed on paper by the RTA. Many families have left names uncorrected on the belief that nothing can be done with physical shares any more.
How do I change my name on my demat account after marriage?+
Correct PAN on the marriage certificate first, then file the DP's KYC modification form with the certificate, PAN and Aadhaar, at the branch or in the app with verification where the DP asks. The depository and the KYC registration agency update the name; the holdings do not move. Update the bank account the dividend goes to in the same week.
Why was my dematerialisation request rejected?+
Almost always the depositories' name alert: NSDL and CDSL validate a demat request against the RTA's database of physical holders and bounce it where the certificate name does not match the account name. Correct whichever is wrong, the certificate at the RTA or the account at the DP, then resend the demat request with the corrected certificate.
I hold Coal India shares from the 2010 employee quota in my payroll name. What do I do?+
Match the folio or demat account to your corrected PAN and Aadhaar; a payroll spelling with initials or a Devi is usually a minor mismatch under SEBI's norms and is fixed on ISR-1 or the DP's KYC without any gazette. The employer's own service record is a separate matter under the departmental deed; the RTA and DP read only PAN and the listed KYC documents.
My father held Tata Steel shares in physical form and has died. Can I change the name to mine?+
Not by a name change. Shares pass to heirs by transmission, on the RTA's transmission forms with the death certificate, the succession documents and the nominee's or heirs' KYC. A name change is for the living holder's own name. Where the deceased had changed name in life, the Gazette or certificate kept with the certificate is what lets the heirs prove he was the holder.
What does the RTA need for a change of name?+
PAN and Aadhaar already in the new name, the folio's KYC on ISR-1, the original certificate, the RTA's request form with the name typed as on PAN, and the legal instrument for the reason: the registered marriage certificate, the certified decree or the Gazette of India notification printed with its number, date and page. ISR-2 with the banker's attestation if the signature changed. No newspaper cutting and no affidavit for a minor mismatch.
How long does it take and what does it cost?+
Physical, about 15 to 30 working days for the reissued certificate; demat, about 7 to 15 for the account update; a Gazette, where a chosen change needs it, 3 to 7 weeks before either. The RTA's or DP's charge is nil or small; courier, notary and the Gazette's commonly Rs 1,100 are at actual cost.
What happens to dividends while the name is wrong?+
They are paid electronically to the bank account on the folio or the demat record, in the record name; a bank returns a credit whose beneficiary name does not match, the company parks it as unpaid, and after seven years the unpaid dividends and the shares themselves go to the Investor Education and Protection Fund, from which they are reclaimed by a separate process. Correct the name and the bank account together.
The RTA refused. Where do I complain?+
Resubmit against the acknowledgement number with the missing document, quoting the clause of Annexure C of SEBI's March 2023 circular that governs your case if the RTA asked for more than it requires. Then the RTA's investor grievance officer in writing, then SEBI's SCORES portal, and the Online Dispute Resolution portal beyond it.
Does the Jharkhand Gazette work as proof for the RTA?+
Not today. The Jharkhand Gazette carries Government notifications and, as reported, stopped printing personal name changes in July 2025; the practice is under inquiry. The instrument every RTA and DP checklist names is the Gazette of India, Part IV, from Delhi.
