A decree of divorce is the Family Court's order dissolving the marriage. A certified copy is a copy issued by the court's copying section under seal, and it is the certified copy, not a photocopy or the lawyer's file copy, that Aadhaar, PAN and the passport office act on. The decree names both parties as they stood in the petition, usually in the married name, and records the dissolution and its date. That is enough: it proves the marriage that produced the married name has ended, and the offices then switch you back to the name your older records already carry.

Where to get it

From the copying section of the court that passed the decree: the Family Courts at Ranchi, Jamshedpur, Dhanbad and Bokaro, or the district or sub-divisional civil court elsewhere. A small copying fee per page. Ask for three certified copies at once.

What it must show

Both names as in the petition, the court, the case number, the date of the decree and the seal. If your maiden name appears nowhere on it, that is normal; the link to the maiden name comes from your birth certificate, Class 10 certificate and old Aadhaar, which you carry alongside.

Mutual consent and contested

A decree under Section 13B of the Hindu Marriage Act by mutual consent, a contested decree, or a decree under the Special Marriage Act all work the same way. A Muslim divorce needs the court's decree or, where the office accepts it, the registered talaqnama or khulanama; ask the Seva Kendra before relying on a Qazi's certificate alone.

Separated in Jharkhand With No Decree Yet: Changing Your Name Anyway

Family Court cases in Jharkhand can run for years. You do not have to wait.

A decree is the divorce-specific proof, but nobody in India needs anyone's permission to change their own name. If you are living apart, the petition is pending or has not been filed, and you want your maiden name back now, the ordinary route is open: an affidavit sworn in your district, notices in one Hindi and one English daily, and a change of name published in Part IV of the Gazette of India at commonly Rs 1,100. The affidavit states the reason plainly, separation and a wish to resume the maiden name, and the proforma reads as any change of name does, "hitherto known as ... shall hereafter be known as", signed in the married name you currently hold.

The husband is not a party to a change of name and does not sign anything. The two witnesses are any adults who know you.

What changes later

When the decree comes, nothing further is needed for the name; the Gazette already did it. The decree still matters for maintenance, custody and property, which are separate matters.

Your Children's Surname After a Divorce in Jharkhand

The question that comes up on every divorce call, and the one with the least honest answer online.

A child's name is the child's. It does not change when a parent's does. A mother who goes back to her maiden name does not thereby change her son's surname, and a father's surname on a child's birth certificate and school record stays there unless a separate process changes it. Changing a minor's name is its own route, with its own document set, and the parent who applies has to show the right to do so.

What the child's records carry

Birth certificate: both parents' names as registered. School and JAC records: the name at admission, usually the father's surname. Aadhaar: the child's own name; a parent's name only in the optional care-of line of the address.

Who can apply to change it

Both parents together, or the parent holding a custody or guardianship order from the Family Court. A parent without custody cannot change a child's name alone, and a change made without the other parent's consent or a court order is the kind that gets challenged later.

How it is done

The minor route: the parent as deponent on the affidavit, the child's date of birth stated, the "SPECIMEN FORM FOR CHANGE OF NAME OF MINOR" in the Gazette of India at commonly Rs 1,700, then the school, JAC before the result, and Aadhaar. Two things a divorce decree does not do. It does not change a child's surname, and it does not by itself remove the father's name from a child's birth certificate. Both are separate matters, and the birth register is corrected only by the Registrar under Section 15 of the RBD Act, 1969, never by a gazette.
