The decree is your proof • No gazette in the ordinary case • The passport office does not even ask for it

Reverting to Your Maiden Name After Divorce in Jharkhand

Almost every page you will find on this subject sells a gazette notification. For an ordinary return to your own name after a decree, you very likely do not need one. The passport rules put a change following marriage, remarriage or divorce in the group that needs no further proof, and the Ministry of External Affairs went further when it simplified those rules, stating that a separated or divorced applicant is not required to provide even the Divorce Decree. Your decree is the document that does the work everywhere else, and this page tells you how to get a certified copy of it in Jharkhand, which offices to visit in what order, and the one case where a gazette genuinely is the answer.

1Document that does the work, the decree

Quick answer

Going back to your own name after a decree is one of the simpler things in Indian documentation, and the reason it looks hard is that the pages written about it are selling something. The decree is your proof. Get a certified copy of it from the court that passed it, which for a Family Court matter in Jharkhand means that court's copying section at the district court, with an online copy application available through the district courts system, and then work through the offices in order: Aadhaar first, then PAN, then the bank, then everything that reads those two. On the passport, the rules treat a change following marriage, remarriage or divorce as needing no further proof, and the simplification of those rules went further still, stating that the form does not require the name of a spouse for a separated or divorced applicant and that such applicants are not required to provide even the Divorce Decree. Three situations get mixed up on this subject and only one of them needs a gazette. Going back to your maiden name after a decree runs on the decree. Going back while still married, where there is no decree, is treated as a full name change and that is where a gazette genuinely comes in. And a widow returning to her own name has yet another position again, resting on the death certificate. One thing that has nothing to do with names but matters more after a divorce than at any other time: go through every nomination you hold, on the bank account, the insurance policies, the provident fund and the pension. That is the paperwork people forget, and it is the one that causes real harm later.

The Divorce Decree and How to Get a Certified Copy in Jharkhand

Reverting to your maiden name after divorce in Jharkhand using the decree
The decree does the work. Get a certified copy and the rest is a sequence of visits.

A photocopy of the judgment is not what offices want. What they accept is a certified copy, issued by the court itself, carrying the court's seal and the copying section's endorsement. Get two or three at once, because you will be handing them over.

Where to apply for a certified copy of a decree in Jharkhand and what you need
Where your matter was decidedWhere the certified copy comes fromWhat to carry
Family Court or district court, which covers most divorces in JharkhandThat court's copying section at the district court. The district courts system also provides an online copy application and a way to check the status of a copying applicationThe case number and year, the name of the court, the parties' names, and the prescribed application with the copying fee
Jharkhand High Court, if the matter went in appeal or by writThe High Court's own online certified copy service, which works on the case type, case number and filing numberThe case type, number and year exactly as the High Court record shows them
You no longer remember the case detailsYour advocate's office is the fastest route, and the court's case status search can find it from the parties' names and the yearRoughly when it was decided, and the names as they appeared in the case
Ask for more than one copy on the same application. Aadhaar, the bank, the passport office and sometimes an employer each want to see it, and some keep the copy they are given. Applying twice means paying twice and waiting twice. Also check the copy before you leave: your name should appear exactly as it does on your other documents, and the decree should show the date it was passed and, where relevant, that it has become final.

A point worth saying plainly, because it decides what you can do next. This page is about documents. Anything to do with the terms of the decree itself, with custody, with maintenance or with an appeal belongs with your advocate, not with a documentation consultancy, and we will tell you so if you ask us.

Three Situations People Confuse, and Which One Needs a Gazette

Nearly every page on this subject treats these as one thing and sells a gazette for all three. They are not one thing, and only one of them needs a published notice.

Three situations in which a woman returns to her maiden name and what each one needs
Your situationWhat proves the changeGazette needed
1. Divorced, and going back to your own nameThe certified copy of the decree. The passport rules place a change following divorce in the group needing no further proofNo, in the ordinary case
2. Still married, and wanting your maiden surname backNothing records this step, because no decree and no certificate exists for it. It is treated as a name changeYes, this is the case a gazette is actually for
3. Widowed, and going back to your own nameThe death certificate, with your marriage certificate where the link needs showingUsually no, and the passport rules treat a widow separately again
Separated but not divorcedNothing yet. In documentation terms you are in situation two until a decree existsTreat it as situation two, and read the warning below first
If you are still married and want your maiden surname back, read this before spending anything. An undated notification of the Department of Publication was reported in March 2024 as requiring a married woman seeking a maiden surname to furnish either a divorce decree or a no objection certificate from her husband, with his identity proof and mobile number attached, and as saying that where divorce proceedings are ongoing the change could not be processed until the final verdict. It drew wide criticism and was challenged in the Delhi High Court, which issued notice and sought the central government's response, with a hearing listed for 28 May 2024. We have not seen that notification ourselves and we do not know the position after that hearing. If your situation is a difficult one, confirm the current requirement with the Department before you prepare any file, and read our surname change in the gazette page, which sets this out in full.
And the other half of that story, which almost nobody prints. If you do hold a decree, none of the above applies to you. Your route is the simple one on this page, your decree is the proof, and the passport office does not even ask to see it. Be careful not to let an agent quote you for the difficult situation when you are in the easy one.

The wider question of whether any name change was ever compulsory in the first place is on our is a name change compulsory after marriage page, and it is worth reading, because a good number of women discover they never changed their name on marriage at all and so have nothing to undo now.

What Each Office Asks For When You Go Back to Your Maiden Name

The decree does the work, but each office has its own form and its own habit. This is the practical version.

What each office asks for when reverting to a maiden name after divorce in Jharkhand
OfficeWhat it asks forWorth knowing
AadhaarThe certified copy of the decree, with the update formDo this first, because nearly every other office verifies against it. The fee is charged per attempt with no refund and name updates are limited in number, so get the spelling right once
PANThe decree, the correction form and the updated AadhaarA correction, never a fresh application. The number does not change, and a second PAN carries a penalty of Rs 10,000 under section 272B
Bank and post officeA branch visit with the decree, updated Aadhaar and PAN, and a fresh signatureReview the nominee in the same visit. Cards and cheque books are reissued
PassportA reissue applicationThe rules treat a change following divorce as needing no further proof, and the simplified rules state that a separated or divorced applicant need not give a spouse's name and is not required to provide even the Divorce Decree
Voter identity cardThe decree with the correction applicationIf you also moved back to your parents' district, shift the constituency in the same application rather than only changing the name
Driving licence and vehicle papersThe decree at the district transport officeBoth the licence and the registration certificate carry a name. Check both
LIC, insurance and provident fundThe decree with each organisation's own endorsement formThe name matters less here than the nominee, covered in the next section. This is the most neglected paperwork after a divorce
Employer and service recordThe decree through the establishment sectionThe service book, the provident fund record and the salary account should move together, in one written request
School, board, degree and caste certificateNothing. They already carry your maiden nameThis is the quiet advantage of going back to your own name. Your oldest and most important certificates already agree with it
The thing that makes this easier than a marriage name change. When you go back to your maiden name, you are returning to the name your Class 10 certificate, your degree and your caste certificate already carry. At a document verification that is the strongest position there is, because the oldest records and the newest ones say the same thing, and the decree explains the years in between. Keep the certified copy with those certificates permanently.

The individual routes are set out on our Aadhaar, PAN, bank records, passport and LIC policy pages.

The Nominations to Review After a Divorce, Which Have Nothing to Do With Names

We put this on the page because it is the single most useful thing we can tell somebody in this situation, and because no page selling a gazette will ever mention it. It costs nothing and takes an afternoon.

1

Bank accounts and deposits

Every savings account, fixed deposit and recurring deposit carries a nominee. Change them at the branch in the same visit as the name update.

2

Insurance policies

Life and health policies both carry nominations. Each insurer has its own endorsement form, and a policy can sit for years with a nominee nobody intended.

3

Provident fund and pension

Filed through your employer's establishment section. This is the one most often left as it was, and the one with the largest amount attached to it.

4

Demat, mutual funds and small savings

Post office schemes, PPF, mutual fund folios and demat accounts each hold their own nomination.

5

Gratuity and employer benefits

Separate from the provident fund, and separately nominated. Ask the establishment section for the full list of what you have nominated on.

6

Write down what you changed

One sheet, dated, kept with your papers. Six months later nobody remembers which ones were done.

Why this matters more than the name. A nomination decides who an institution pays. Left unchanged after a divorce, it can direct money to a person you did not intend, and the people who have to sort that out are your parents or your children, at the worst possible time and usually through a long process. Nothing on this page is more worth your afternoon than this section, and it is entirely free.

One honest boundary, again. What a nomination does and does not decide in law, and how it sits alongside a will or a succession claim, is a question for a lawyer. What we are telling you is simply to go and look at yours, because most people never do.

The Order to Go Back to Your Maiden Name in Jharkhand

Done in this order it is a handful of visits. Done in the wrong order, several of them are repeated.

1

Get two or three certified copies

From the copying section of the court that passed the decree. Offices keep the copy you hand over, so one is never enough.

2

Check the name on the decree

It should match your other papers letter by letter. Raise a discrepancy with the court now, not after four offices have copied it.

3

Write down the exact name you are returning to

Usually the one on your Class 10 certificate. Spelling and spacing included, and never varied after this point.

4

Update Aadhaar first

Everything downstream verifies against it. The fee is per attempt with no refund and name updates are limited, so do it once and correctly.

5

Correct the PAN

A correction to the same PAN, never a fresh application. The number stays the same.

6

Bank, and the nominee in the same visit

Name, signature and nomination together. Ask for the list of every account and deposit in your name at that branch.

7

Insurance, provident fund and pension

Name endorsement and nomination together again. Through the employer's establishment section where that applies.

8

Voter card, licence and the rest

Including a constituency shift if you moved back to another district, done in the same application.

9

Passport when the first two agree

Once Aadhaar and PAN carry your own name again, the reissue is straightforward.

What you do not have to do, and this is the good news. Your Class 10 and Class 12 certificates, your degree and your caste certificate already carry your maiden name. Nothing there needs an application, a fee or a wait. You are not creating a new name, you are coming back to the one your oldest records have held all along, and that is why this is a shorter job than the one you did after marriage.

Central Gazette Process From Jharkhand, for the One Case After Divorce That Needs It

No district in Jharkhand has a gazette counter, so the file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.

The Eight Steps of a Marriage Name Change File Sent From Jharkhand

1

Settle the final name first

Write it out letter by letter, with the spacing you want, and then use exactly that in every paper. A corrigendum after publication is a second fee and a second wait.

2

Pick the category, then its proforma

Adopting a maiden surname where a woman is resuming her own family name without a decree, change of name for an adult where the whole name is changing, or a public notice where a name was simply written wrongly. Twelve categories exist and only one is yours.

3

Type the proforma in duplicate

Two originals, signed in your existing old name, with two witnesses giving signature, full name, address and mobile number on both copies. The adult form also asks for your post and your office or company.

4

Get the affidavit attested at the right level

A notary for the ordinary change of name, and a First Class Magistrate of the concerned area where the different surname guidelines apply. This is the step that catches people out.

5

Publish and keep the original paper

One of the daily local leading newspapers, carrying the married name in full, the maiden name you are returning to, the father's name and the address. The whole original paper goes in the file.

6

Pay only through BharatKosh

The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.

7

Check every date, then post it yourself

Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.

8

Read the notice, then download it

Check both names letter by letter the day it publishes, note the page and issue number, and download the e-Gazette copy of that Part IV issue.

The Five Papers in the File, and What Is Checked in Each

The five papers of a Central Gazette marriage name change file and what the Department checks in each
The paperWhat is checked in it, clause by clause
1. The proforma, in duplicateThat it is the right category's format; the existing full name exactly as your documents carry it, surname included; the maiden name you are returning to, exactly as your Class 10 certificate carries it; the father's or husband's name; the full address with pin code; the signature in the old name; two witnesses complete with signature, full name, address and mobile number
2. The affidavit or undertakingSigned by the applicant; the same names and address as the proforma, word for word; attested at the level the category asks for, which is a First Class Magistrate for the adopting a different surname route; on Rs 100 non-judicial stamp paper as our safe default
3. The original newspaperThe original paper, not a cutting; the paper's name and date of publication visible; both names carried; the same spelling as the proforma; dated within the last year
4. Photographs, identity proof and any category paperTwo self-attested passport photographs; identity and address proof matching the proforma address; both witnesses' proofs; and whatever the category itself demands, such as a decree or a no objection certificate where the maiden surname requirement applies
5. The CD, its certificate and the BharatKosh receiptMS Word, without the witness portion, the old name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt
The proforma is where files are lost, and there are twelve to choose from. A maiden surname file typed on the ordinary change of name form, or a change of name typed on a surname form, comes back. The Government charge already paid is not refunded, because BharatKosh payments are non-refundable. You then have six months to make good a shortcoming the Department points out, after which a fresh application with all new documents is required.
What to select on BharatKosh, field by field. Pay to the Department of Publication under the Ministry of Housing and Urban Affairs, and pick the Ministry, the Pay and Accounts Office and the Drawing and Disbursing Officer by their names in the dropdown, never by a code copied off a website. The codes printed for this office on different websites do not agree with each other, and money paid into the wrong head cannot be traced to your file. Read the amount on the portal on the day you pay, because it is revised each financial year.
How to read the published notice before you rely on it. Open the e-Gazette copy and check five things: that it says Part IV; the date of publication; your old full name exactly as your documents carry it, with the surname spelt as it appears there; the maiden name, letter by letter, against your Class 10 certificate; and the father's or husband's name and address. Then note the page number and the issue number, because that is what an office will quote back to you at verification.

The posting detail is on the sending the file to Delhi page, the wording on the proforma format page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.

What Going Back to Your Maiden Name Costs in Jharkhand

Cost and time for reverting to a maiden name in Jharkhand
ItemCostTime
Where the decree does the work, which is the ordinary caseThe court's copying fee for two or three certified copies, plus the ordinary office fees. No change of name charge at all, and your school, board and caste certificates need nothing because they already carry your maiden nameA few weeks across Aadhaar, PAN, the bank and the nominations
Government printing chargeThe Department's guidelines print Rs 1,100 for a change of name of an adult or major for the financial year 2016 to 2017, adding that it varies each financial year and from case to case, and Rs 3,500 for an Indian living abroad. The guidelines also show an additional Rs 250 on top of the Rs 1,100 in certain cases, taking that total to Rs 1,350, and the Department publishes a separate note on where additional charges apply. Which case triggers it is not something we will state from a summary, so read the amount on BharatKosh. A public notice is printed at Rs 1,400 for the same yearPart IV publishes weekly, so allow several weeks from posting
AffidavitRs 100 non-judicial stamp paper plus the attestation. A notary is enough for an ordinary marriage affidavit. A First Class Magistrate is only for the adopting a different surname routeNotary the same day; a magistrate needs a planned court visit
NewspaperPaid to the paper, charged by lengthSame week
Post or courier to DelhiSent in your own name from any district, and keep the receiptA few days each way
Updating the records afterwardsAadhaar charges a fee per attempt with no refund, and the other offices have their own small chargesSeveral weeks across all of them
Our chargeQuoted on your papers before you pay anything, and confirmed in writing. We print no service price on any page of this site
Do not trust a figure printed on any website, including this one, on the day you pay. The Department's own guidelines say the printing charge varies each financial year and from case to case, so the figures above are what the published guidelines show for 2016 to 2017 and are given so you know the order of the amount, not the amount. What BharatKosh shows when you reach the payment screen is the one that counts. Read it there and pay that.

The honest total, in the rare case a gazette is genuinely needed after a marriage, is the Government charge, the affidavit, the newspaper and the postage, and then several weeks of waiting for Part IV. The cost that surprises people is not any of these. It is the second file, caused by a name settled carelessly at step one, and it is entirely avoidable. Our corrigendum page explains what that second file involves.

Myths About Changing Your Name Back After Divorce

Common beliefs about a name change after divorce and what is actually correct
What people are toldWhat is actually so
A gazette notification is required after divorceNot in the ordinary case. The decree is the proof, and the passport rules place a change following marriage, remarriage or divorce in the group needing no further proof. A gazette is for the woman who wants her maiden surname back without a decree
I must show my divorce decree at the passport officeThe simplified passport rules state that the form does not require a spouse's name for a separated or divorced applicant and that such applicants are not required to provide even the Divorce Decree
A newspaper advertisement is neededNo. A newspaper notice belongs to a gazette file. If somebody has quoted you for one simply because you divorced, ask which office demanded it in writing
A photocopy of the judgment will doIt will not. Offices want a certified copy from the court, with its seal and endorsement. Get two or three, because offices keep the copy you hand them
I need to get my Class 10 certificate changedIt already carries your maiden name. Going back to your own name means your oldest certificates are already correct, which is what makes this easier than a marriage name change
I should apply for a fresh PAN in my maiden nameNever. It is a correction to the same PAN, the number does not change, and a second PAN carries a penalty of Rs 10,000 under section 272B
Changing the name is the important paperwork after a divorceThe nominations are, and almost nobody mentions them. A nomination decides who an institution pays, and one left unchanged can send money where you never intended
My children's surname changes automatically with mineIt does not. A child's name is a separate matter with its own route and, where a court has made orders about the child, its own limits. That belongs with your advocate first
The belief that costs the most money. That a divorce automatically means a gazette. Every page at the top of the search results on this subject is written by somebody who sells gazette files, which is why they all say the same thing. If you hold a decree, the honest answer is that you very likely need nothing published at all, and that you should spend the money on certified copies and an afternoon on your nominations instead.

Reverting to a Maiden Name After Divorce: Frequently Asked Questions

Do I need a gazette notification to go back to my maiden name after divorce?+
In the ordinary case, no. The certified copy of your decree is the proof, and the passport rules place a change following marriage, remarriage or divorce in the group that needs no further proof. A gazette is the answer for a different situation: a woman who wants her maiden surname back while still married, where no decree exists to record the step. Every page at the top of the search results says otherwise, and every one of them sells gazette files.
How do I get a certified copy of my divorce decree in Jharkhand?+
From the copying section of the court that passed it, which for most divorces in this state means the Family Court or district court, on a prescribed application with a copying fee. The district courts system also provides an online copy application and a way to check the status of a copying application. If your matter went to the Jharkhand High Court in appeal or by writ, that court has its own online certified copy service, worked on the case type, case number and filing number. Take two or three copies, because offices keep the one you hand over.
Will the passport office ask for my divorce decree?+
No. When passport rules were simplified the Ministry of External Affairs stated that the application form does not require the name of a spouse for a separated or divorced applicant, and that such applicants would not be required to provide even the Divorce Decree. This is worth knowing in advance, because it is one of the most stressful assumptions people carry into a passport office.
Which document should I update first?+
Aadhaar, because almost every other office verifies the new name against it. Then PAN as a correction, then the bank, then the voter card, the driving licence, the insurance and the employer record, and the passport once Aadhaar and PAN agree. The Aadhaar fee is charged per attempt with no refund and name updates are limited in number, so settle the spelling before you go, not at the counter.
Do I have to change my school certificates and my degree?+
No, and this is the part that surprises people. Those certificates already carry your maiden name, because they were issued before the marriage. Going back to your own name means your oldest and most important records are already correct, which is exactly why this is a shorter job than the one you did after marriage. Keep the certified copy of the decree with them.
What if I never actually changed my name when I married?+
Then there is nothing to undo, and you are already finished. No law in India ever required the change, and a good number of women discover at this point that their papers stayed in their own name throughout. In that case the only thing worth doing from this page is the nominations section, and it is worth doing today.
What paperwork matters most after a divorce?+
Your nominations, and nobody selling a name change will tell you so. Bank accounts and deposits, life and health insurance, provident fund, pension, gratuity, mutual funds, demat and small savings schemes each carry a nomination, and a nomination decides who the institution pays. Left unchanged it can direct money where you never intended, and the people who have to untangle it later are your parents or your children. It costs nothing and takes an afternoon.
Does my child's surname change when mine does?+
No. A child's name is a separate matter with its own route, and where a court has passed orders about the child there are limits on what either parent may do alone. That question belongs with your advocate before it belongs with a documentation consultancy. Our minor name change page sets out the documentation side once the legal position is clear.
I am separated but not yet divorced. Can I go back to my maiden name?+
In documentation terms you are in the harder situation until a decree exists, because nothing records the step. That is the case where a gazette comes in, and it is also the case affected by a requirement reported in March 2024 of a decree or a husband's no objection certificate, which was challenged in the Delhi High Court with a hearing listed for 28 May 2024. We have not seen that notification and do not know the position after that hearing, so confirm the current requirement with the Department before preparing anything.
Is a widow's position the same as a divorced woman's?+
Similar but not identical. A widow returning to her own name rests on the death certificate, with the marriage certificate where the link between two names needs showing, rather than on a decree. The passport rules deal with a widowed applicant separately as well. The office sequence afterwards is the same as on this page, and so is the advice about nominations.
What does this cost in Jharkhand?+
In the ordinary case, the court's copying fee for two or three certified copies, plus the ordinary office charges at Aadhaar, PAN, the bank and the rest. There is no gazette charge because there is no gazette, no newspaper cost because there is no advertisement, and nothing at all for your school, board and caste certificates because they already carry your maiden name. If somebody has quoted you thousands for this, ask them which office asked for what they are charging you for.
Will you ask me about the divorce?+
No. We need the certified copy of the decree, your Aadhaar and PAN, and one old certificate carrying your maiden name. Nothing about the marriage, the grounds or the case, and we will not ask. Anything touching custody, maintenance or the terms of the decree belongs with your advocate, and we will say so plainly rather than take on work that is not ours.

Who wrote and checked this page

Written and maintained by the Jharkhandnamechange.com documentation desk, led by founder Vipin Chauhan, B.Tech LL.B, with 5+ years filing with the Department of Publication. That a change following marriage, remarriage or divorce is treated as needing no further proof comes from the passport name change rules. That the application form does not require a spouse's name for a separated or divorced applicant, and that such applicants are not required to provide even the Divorce Decree, is quoted from the Ministry of External Affairs document on the simplification of passport rules, linked below. The routes for a certified copy follow the courts' own published services: the district courts system, which provides an online copy application, the prescribed format for a certified copy application and a copying application status check, and the Jharkhand High Court's own online certified copy service for matters decided there. The March 2024 maiden surname requirement described on this page, a divorce decree or a husband's no objection certificate with his identity proof and mobile number, and the challenge before the Delhi High Court with a hearing listed for 28 May 2024, is taken from news reporting of an undated notification. We have not seen that notification ourselves and we do not know the position after that hearing, which is why this page asks you to confirm the current requirement before preparing a file. The Rs 10,000 penalty for holding a second PAN is under section 272B of the Income Tax Act. On nominations this page tells you to go and look at your own, and deliberately does not state what a nomination decides in law, because that is a question for a lawyer. We are a documentation consultancy and not advocates, and custody, maintenance and the terms of a decree are not our work. Who we are is on the about page.

Official Sources on a Maiden Name After Divorce

Reverting to Your Maiden Name in Eight Lines

The short version

  • The decree is your proof, and in the ordinary case no gazette is needed.
  • Get two or three certified copies from the court's copying section.
  • A separated or divorced passport applicant need not even provide the decree.
  • Aadhaar first, then PAN as a correction, then the bank and the rest.
  • Your school, board and caste certificates already carry your maiden name.
  • A gazette is for a maiden surname wanted while still married, not after a decree.
  • Review every nomination you hold. It is free and it matters more than the name.
  • Custody, maintenance and the terms of the decree belong with your advocate.

Before you pay for a gazette after a divorce, check whether your decree already does the job.

Send the certified copy and your Aadhaar. We will tell you the route, the order of offices and the total, and we will not ask about the case.
