Shares of a deceased holder pass to the joint holder, nominee or legal heirs by transmission • SEBI sets simpler papers up to Rs 5 lakh physical or Rs 15 lakh demat • Names on the death certificate and heirs' KYC must line up

Shares and Mutual Fund Transmission Name Mismatch in Jharkhand: Heirs, Nominees and SEBI Rules

When a parent dies leaving shares or mutual funds, the family must get them moved by transmission. SEBI's FAQ defines it as the process by which securities of a deceased holder go "to the account of the surviving joint holder (s) / nominee / legal heirs". The papers are set out clearly, but a transmission often stalls on a name: the father's name on the share certificate differs from the death certificate, or a married daughter's KYC carries her new surname. Most of these are fixed with documents, not a Gazette notice. We publish Gazette notices, and we say this first.

5Rs lakh limit for simpler papers, physical shares, per SEBI
15Rs lakh limit for simpler papers, demat, per SEBI
21Days for the registrar to process transmission, per SEBI
0Gazette notices usually needed for a slip
Quick answer

Five points, in the order you will need them. First, find out whether there is a joint holder or nominee; that decides the papers. Second, a joint holder or nominee gives Form ISR-5, KYC and the death certificate. Third, without a nominee, legal heirs give affidavits, an indemnity bond and no-objection from other heirs, or a succession certificate for larger values. Fourth, check that the deceased's name matches on the certificate and the death certificate, and that each heir's name matches their KYC. Fifth, the shares come to the heir in demat, per SEBI. We publish Gazette notices, and we say plainly that most transmission name problems need none.

What SEBI Says About Transmission of Shares to Heirs

Shares and mutual fund transmission name mismatch in Jharkhand, with a death certificate, share certificate and heirs' PAN cards
Transmission moves a deceased holder's securities to the heirs.

SEBI's FAQs for share registrars (RTAs), under its Master Circular of 23 June 2025, cover transmission in questions 67 to 73. These are the rules for shares of listed companies.

Key points of SEBI's FAQs on transmission
PointWhat SEBI's FAQ says
Who can claim"a joint holder or nominee or legal heir as the case may be"
Form"transmission request form ISR – 5", with KYC details and documents
Death proof"Original death certificate or copy of death certificate"
How the heir gets themSecurities are "issued in demat mode only"
Time for the registrar21 days, per SEBI's timeline table
Mutual funds follow their own registrar. The FAQ we read is for shares held with company registrars. Mutual fund units are handled by the fund's registrar, and we did not read SEBI's mutual fund transmission rules. Ask the fund's registrar for its checklist; the name-matching advice below applies the same way.

Which Transmission Name Case You Have

Transmission name problems usually fall into a few kinds. This sorting is ours, since SEBI's transmission FAQs do not deal with name mismatch.

Kinds of name problem in a transmission
What does not matchWhat it usually is
Deceased's initials on the certificate, full name on death certificateA short form of the same name
Death certificate misspeltA slip at the Registrar
Nominee's name in the folio differs from their KYCA short name, or a married surname
Legal heir certificate spells an heir differentlyA slip on the heir certificate
An heir genuinely changed nameA change needing proof of old and new names
SEBI's minor mismatch rule may help. For service requests, SEBI's FAQ treats initials like "S. R. Shah" against a full name as a "minor mismatch", explained with a document such as Aadhaar or PAN. Whether the registrar applies it in a transmission is our reading, so ask. See our physical share certificate page.

How to Fix Each Name Problem in a Transmission

Fix names before you send Form ISR-5. This is our practical advice, since SEBI's transmission FAQs set the papers but not how to reconcile names.

Fixing each kind of transmission name problem
ProblemWhat usually fixes it
Deceased's initials on the certificateThe deceased's Aadhaar or PAN showing the full name
Death certificate misspeltRegistrar correction. See death certificate correction
Married daughter's surnameHer marriage certificate. See married women
Heir's name on the legal heir certificateCorrect it with the issuing authority first
Heir genuinely changed nameA Central Gazette notice, then the heir's PAN and demat account
Each heir's KYC must be clean. Form ISR-5 goes "along with KYC details/documents", and the shares land in the heir's demat account. If the heir's PAN, Aadhaar and demat name agree, the transmission is far smoother. See our demat and mutual fund page.

Transmission Papers With a Nominee, and Without One

SEBI's FAQ 72 sets two routes for heirs where there is no nomination, depending on value. Every paper carries names, so check them all.

Transmission papers, per SEBI's FAQs 70 to 72
CaseWhat SEBI's FAQ asks for
Surviving joint holderForm ISR-5 with KYC, and the death certificate
NomineeThe transmission request form with KYC, and the death certificate
No nominee, above Rs 5 lakh physical or Rs 15 lakh dematNotarised affidavits from all heirs, or a succession certificate, probate or letters of administration; a notarised indemnity bond; no-objection from non-claimants
No nominee, up to Rs 5 lakh physical or Rs 15 lakh dematA simpler option: a notarised indemnity bond with no-objection from all legal heirs, or a family settlement deed
Affidavits are needed here. Unlike ordinary service requests, SEBI's FAQ says transmission is one of the cases where more than self-attested copies are needed. Every heir's name in the affidavits and bond must match that heir's KYC. Whether a court certificate is needed is a question for a lawyer.

Does a Transmission Name Mismatch Need a Gazette Notice?

Usually not. A deceased's initials are explained with Aadhaar or PAN; a death certificate slip goes to the Registrar; a married daughter uses her marriage certificate. A Gazette notice is for an heir's genuine change of name.

When a Gazette notice is relevant to a transmission
SituationWhat usually applies
Deceased's initialsAadhaar or PAN. No Gazette
Death certificate slipRegistrar correction. No Gazette
Married daughterMarriage certificate. No Gazette
Heir's genuine new nameA Central Gazette notice is the clean route
Our commercial interest, stated plainly. We publish Gazette notices. For most transmission name problems, you do not need one, and a grieving family should not be sold one. From Jharkhand, a genuine change goes in the Gazette of India, Part IV, since the state press stopped personal notices in July 2025, as reported.

How to Claim Shares by Transmission With a Name Mismatch, Step by Step

1

Get the death certificate

Check the name spelling.

2

Find each company or fund and folio

From certificates or statements.

3

Check for a joint holder or nominee

That decides the papers.

4

Compare the deceased's name everywhere

Certificate, death certificate, PAN.

5

Fix the death certificate if wrong

At the Registrar.

6

Check each heir's KYC name

PAN, Aadhaar, demat.

7

Open a demat account for the heir

Shares come in demat only.

8

Prepare Form ISR-5 and the papers

Affidavits, bond, no-objection as needed.

9

Send it to the registrar

Keep a copy and receipt.

10

Follow up after 21 days

SEBI's timeline.

The one rule that holds the whole job together. Fix every name before anyone signs an affidavit. A notarised paper with a wrong name has to be done again.

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Transmission to Heirs

Read this before the rest of this section, because most transmission name problems never need it. A deceased's initials are explained with Aadhaar or PAN; a death certificate slip goes to the Registrar; a married daughter uses her marriage certificate. No Gazette notice is needed for those. It is printed in full for an heir's genuine change of name.

No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.

The Eight Steps of a Name File Sent From Jharkhand

1

Settle the final name first

Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.

2

Pick the category, then its proforma

A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.

3

Type the proforma in duplicate

Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.

4

Fill the employment field if it is a change of name

The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.

5

Publish and keep the original paper

One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.

6

Pay only through BharatKosh

The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.

7

Check every date, then post it yourself

Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.

8

Read the notice, then update in the right order

Check every word the day it publishes and download the e-Gazette copy. Then update the heir's PAN and Aadhaar, then the demat account, then send the transmission papers to the registrar.

The Five Papers in the File, and What Is Checked in Each

The five papers of a Central Gazette name file from Jharkhand and what the Department checks in each
The paperWhat is checked in it, clause by clause
1. The proforma, in duplicateThat it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number
2. The affidavit or undertakingThe same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default
3. The original newspaperThe original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year
4. Photographs, identity proof and any category paperTwo self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error
5. The CD, its certificate and the BharatKosh receiptMS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt
The proforma is where files are lost, and there are twelve to choose from. A wrongly typed spelling filed on the change of name form declares henceforth be known as, claiming a change you never made. The Government charge already paid is not refunded, because BharatKosh payments are non-refundable. You then have six months to make good a shortcoming the Department points out, after which a fresh application with all new documents is required.
What to select on BharatKosh, field by field. Pay to the Department of Publication under the Ministry of Housing and Urban Affairs, and pick the Ministry, the Pay and Accounts Office and the Drawing and Disbursing Officer by their names in the dropdown, never by a code copied off a website. The codes printed for this office on different websites do not agree with each other, and money paid into the wrong head cannot be traced to your file. Read the amount on the portal on the day you pay, because it is revised each financial year.
What a Gazette notice will not do for a transmission. It will not transfer the shares, and it will not correct a death certificate. It links a living heir's old and new names, and nothing more. Since we publish these notices, the honest version is this: for most transmission name problems, you need none. Our name correction against name change page explains the categories.

The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.

What a Transmission With a Name Mismatch Costs

SEBI's FAQ, as we read it, sets no registrar fee for transmission. We print none. The costs are the affidavits, bond and heir papers, and usually not a Gazette notice.

Costs connected with a transmission
ItemWhat we can and cannot tell you
Form ISR-5 at the registrarAsk the registrar; we print no figure
Notarised affidavits and indemnity bondStamp duty and notary fees; Rs 100 stamp paper as our safe default for an affidavit
Succession certificate or probateCourt fees. We print no figure
Demat account for the heirYour DP's charges
Gazette noticeOnly for an heir's genuine new name. Paid on BharatKosh, revised each year and non-refundable
What we chargeQuoted on the call. For telling you which names to fix, nothing
The mistake that costs the most. Getting heirs to sign affidavits before the names are fixed. A name error in a notarised affidavit means doing it again. Fix the names first.

Written and maintained by the Jharkhandnamechange.com documentation desk, led by founder Vipin Chauhan, B.Tech LL.B, with 5+ years filing with the Department of Publication. The transmission rules on this page are quoted from SEBI's FAQs on investor service requests processed by RTAs, questions 67 to 73 and the timeline table, under the Master Circular of 23 June 2025: who can claim, Form ISR-5, death certificate, demat only, the Rs 5 lakh and Rs 15 lakh routes, and 21 days. Three limits are declared openly on the page itself. First, we did not read SEBI's mutual fund transmission rules. Second, SEBI's transmission FAQs do not deal with name mismatch, so that advice is ours. Third, whether a court certificate is needed is for a lawyer. We publish Gazette notices, and this page says plainly that most transmission name problems need none. We are a documentation consultancy and not advocates, not an RTA, not SEBI, and not the Department of Publication. Who we are is on the about page.
