Succession Certificate Name Mismatch in Jharkhand: Deceased and Heir Names in the Petition
A succession certificate is granted by a court, under Sections 370 to 390 of the Indian Succession Act, 1925. Families in Jharkhand usually need one to collect a late parent's bank deposits, shares or other debts and securities when there was no nominee, or when the bank or company asks for it. The name problem comes in two places: the deceased's name reads differently on the death certificate, the passbook and the share folio, or an heir's name differs from the heir's Aadhaar. The cheapest time to fix this is before the petition is filed, by putting every form of the name into it. We publish Gazette notices, and we say this first: a Gazette notice does not correct a succession certificate, and a spelling slip needs no Gazette.
Five points, in the order you will need them. First, collect every paper that carries the deceased's name: death certificate, passbook, share folio, Aadhaar, PAN. Second, list every form of the name and make sure the petition states them all, as one person; this is our advice. Third, check each heir's name against the heir's Aadhaar before it goes into the petition. Fourth, if the certificate is already granted with a wrong name, go back to the same court through your advocate; no other office can change it. Fifth, a Gazette notice does not correct a court's certificate. We publish Gazette notices, and we say this plainly.
What the Indian Succession Act Says About a Succession Certificate
The Indian Succession Act, 1925 is a Central law and applies in Jharkhand. Where a point is our own reading, we say so.
| Point | What the Act or source shows |
|---|---|
| What it covers | Part X, Sections 370 to 390, deals with certificates for the debts and securities of a person who has died |
| Which court | The District Judge where the deceased ordinarily lived at the time of death (Section 371) |
| What the petition must state | Section 372(1): the time of death, the deceased's ordinary residence, "the family or other near relatives of the deceased", the right the petitioner claims, the absence of any bar, and "the debts and securities" claimed |
| Notice | Section 373: the Judge fixes a date and gives notice, including a public notice |
| Security | Section 375: the Judge may ask for a bond with sureties |
| Court fee | Charged on the value of the debts and securities in the certificate, as a district court's reading material reports |
| Revocation | Section 383: a certificate can be revoked for a defect in substance, fraud, or a later court order |
Notice what Section 372 does not list: there is no separate line for the deceased's other names. That is why we advise putting every form of the name in the petition yourself, in the description of the deceased and again in the list of debts, so the certificate the court signs matches what the bank or company holds.
Which Succession Certificate Name Case You Have
Succession certificate name problems fall into a few kinds. This sorting is ours, based on the papers families send us. The most important split is before filing or after the certificate is granted.
| What does not match | What it usually is |
|---|---|
| Deceased's name differs across papers | Short name on the passbook, full name on the death certificate |
| Death certificate itself is wrong | A slip at registration, fixed by the Registrar, not the court |
| Heir's name differs from Aadhaar | A spelling or a name before marriage |
| Father's or husband's name differs | A slip in the "son of" or "wife of" line on one paper |
| Wrong name in a granted certificate | A slip that is now in a court record |
| A debt or share left out | Not a name problem, but it needs the same court |
| Genuine change of name by an heir | A deliberate new name, before or after the certificate |
How to Handle a Name Mismatch in a Succession Certificate Petition
We found no published Jharkhand rule on name mismatches in succession petitions. What follows is how families usually handle them. The table below is our practical advice, to be checked with your advocate.
| Situation | What we usually advise |
|---|---|
| Deceased's name differs across papers | State both forms in the petition, as one person, with an affidavit from an heir. See one-and-the-same affidavit |
| Death certificate is wrong | Correct it with the Registrar before filing. See death certificate correction |
| Heir's spelling differs from Aadhaar | Use the Aadhaar spelling in the petition. See name spelling correction |
| Daughter's name before marriage | Marriage certificate and an affidavit. See name change after marriage |
| Father's name differs on one paper | Explain it in the affidavit. See father's name mismatch |
| Wrong name in a granted certificate | An application to the same court, through your advocate |
| Genuine change of name by an heir | A Gazette notice, shown to the court with the heir's other papers |
The strongest petitions we see name the deceased in full, then add "also known as" with each other form of the name found on the bank or share records. The same forms appear again in the list of debts and securities, against the account or folio that carries them. This is our advice, and it means the certificate, once signed, already answers the bank's question.
If the certificate has already been granted with a wrong name, only the court that granted it can deal with it. A clerical slip is usually taken back to that court by application. One lawyer's answer on a legal advice site, as reported, suggested that a serious error may need a fresh petition. Ask your advocate which applies to your case.
Using a Succession Certificate at the Bank, for Shares and Other Records
The certificate is only useful once each bank or company accepts it. Each one matches the names on it with its own records. This list is our advice.
| Where it is used | What to watch |
|---|---|
| Bank deposits | The deceased's name must match the account. See nominee name mismatch in a bank claim |
| Shares and mutual funds | Folio names must match. See share transmission to heirs |
| Unclaimed deposits | See unclaimed deposit claims |
| Shares moved to IEPF | See IEPF refund claims |
| Land and house | A succession certificate is for debts and securities, not land. Land passes by mutation. See dakhil kharij |
| A debt not listed in the certificate | The certificate covers only the debts it names. Ask your advocate about adding one |
Does a Succession Certificate Name Mismatch Need a Gazette Notice?
No, for a short name, a spelling slip or a name before marriage. These are explained to the court in the petition and an affidavit. A Gazette notice does not correct a court's certificate, and a deceased person cannot publish one. It is only for an heir who has genuinely changed name.
| Situation | What usually applies |
|---|---|
| Deceased known by two names | Both named in the petition, with an affidavit. No Gazette |
| Death certificate slip | Correction by the Registrar. No Gazette |
| Heir's spelling slip | Aadhaar spelling in the petition. No Gazette |
| Daughter's name before marriage | Marriage certificate. No Gazette |
| Wrong name in the granted certificate | Application to the same court. No Gazette |
| Heir's genuine change of name | A Central Gazette notice, shown with the heir's other papers |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Succession Certificate
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then give the original Gazette notification to your advocate, to file with your other papers in the succession petition.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What a Succession Certificate Costs in Jharkhand
The main cost is the court fee, charged on the value of the debts and securities, plus your advocate's fee. Matching the names costs little: an affidavit, perhaps a death certificate correction. Not a Gazette notice, for a slip.

| Advocate's fee | Agreed with your advocate. We do not quote it |

| Death certificate correction | As the Registrar charges. See our death certificate page |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Gazette notice | Only if an heir chooses it for a genuine new name. Paid on BharatKosh, revised each year and non-refundable |
