Partition Deed Name Mismatch in Jharkhand: Bantwara, Co-Sharers and Mutation
A partition deed, or bantwara, divides family property among co-sharers: brothers, sisters, or the heirs of a parent. In Jharkhand the land usually still stands in a grandfather's or father's name in the khatiyan, while each co-sharer carries a different spelling on Aadhaar. A partition deed that names one brother as "Sunil" when the khatiyan family tree says "Sunil Kumar Mahto" can be registered, and then stop at mutation. We publish Gazette notices, and we say this first: a spelling slip in a partition deed needs no Gazette notice.
Five points, in the order you will need them. First, settle the family tree before the deed: who the co-sharers are, and how each is spelt in the khatiyan, the vanshavali and Aadhaar. This is our advice. Second, write each co-sharer's name as on Aadhaar, with "also known as" the khatiyan form where they differ, and the ancestor's name as in the khatiyan. Third, a deed that divides land is generally registered; a memorandum recording a past partition may not need it, as reported. Ask an advocate which yours is. Fourth, a slip in a registered deed is fixed by a rectification deed signed by all co-sharers. Fifth, a spelling slip does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Law Says About a Partition Deed in Jharkhand
We read reports on the Supreme Court's rulings on family settlements and a 2026 guide to registration in Jharkhand. The name advice further down is ours. A partition is a legal transfer of rights among family members. Where any co-sharer disagrees, or the land is tribal, take an advocate.
| Point | What the sources show |
|---|---|
| A deed that divides land | A document that creates or ends rights in land is compulsorily registrable under Section 17 of the Registration Act, as reported |
| A memorandum of a past partition | A note made after the family had already divided, for record, does not need registration, as the Supreme Court held in Kale (1976) and repeated in 2020, as reported |
| Registration in Jharkhand | Through the Jharnibandhan portal and the sub-registrar, with ID of the parties and witnesses, as reported |
| Registration is not mutation | Registration records the deed; it does not update the land record. Mutation is filed separately, as reported |
| Fixing a wrong name | A rectification deed signed by all parties, registered like the original, as reported |
| Stamp duty on partition | Not confirmed for Jharkhand. Ask the sub-registrar |
| CNT and SPT Act land | Some land transfers are restricted. Take an advocate |
So which paper you need depends on what it does: divide now, or record a division already made. Either way, the names must tie back to the khatiyan, or the circle office cannot follow the chain. This is our reading.
Which Partition Deed Name Mismatch Case You Have
Name problems in a partition fall into a few kinds. This sorting is ours, based on the papers families send us.
| What does not match | What it usually is |
|---|---|
| Ancestor's name differs from the khatiyan | The deed used a later or shorter spelling |
| A co-sharer by pet name | The family name, not the Aadhaar name |
| Sister by maiden name, ID in married name | Her Aadhaar changed after marriage |
| Surname dropped or added | Some brothers use Mahto, some Kumar |
| Deed and vanshavali differ | Two papers made at different times |
| A dead co-sharer's heirs named loosely | "Wife and children of" without names |
| A completely different name | A genuine change of name by a co-sharer |
How to Fix Names in a Partition Deed, Before and After Registration
When you fix it decides how hard it is. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Deed not yet registered | Ancestor as in the khatiyan; each co-sharer as on Aadhaar, with "also known as" the family-tree form |
| Registered deed, all co-sharers alive and willing | A rectification deed, signed by all. See property registry name correction |
| A co-sharer refuses or has died | Court route or heirs. Take an advocate. See succession certificate |
| Khatiyan itself is wrong | See jamabandi and khatiyan correction |
| Sister's married name | Marriage certificate and affidavit. See affidavit after marriage |
| Only a memorandum of past partition | Names should still tie to the khatiyan. Ask an advocate whether it will serve for mutation |
| Genuine change of name | A Gazette notice, then the deed carries both names |
Before registration, sit with the deed writer and the vanshavali. Read each name aloud against the khatiyan and that person's Aadhaar. Write "son of" and "daughter of" lines with care: they are how the circle office follows the chain. Where any co-sharer's names differ, add a one-and-the-same affidavit. The sub-registrar and the circle office decide whether it is enough. This is our advice.
Where one parent is still alive and wants to pass land on, a gift deed or a will may suit better than a partition. Which suits your family is a question for an advocate.
Mutation and Later Records After a Partition Deed
After the deed, each co-sharer's share has to reach the land record and every paper built on it. This list is our advice.
| Record | What to watch |
|---|---|
| Mutation of each share | See dakhil kharij mutation |
| Land possession certificate | See LPC name mismatch |
| Farmer records | See PM-Kisan and farmer registry |
| Crop insurance and KCC | See Fasal Bima and Kisan Credit Card |
| House tax for a divided house | See municipal holding tax |
| Compensation if land is acquired | See land acquisition compensation |
Does a Partition Deed Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a pet name, a dropped surname or a maiden name. Those are handled by "also known as", the family tree, an affidavit, or a rectification deed. A Gazette notice is for a genuine change of name, and even then the deed itself is not changed by it.
| Situation | What usually applies |
|---|---|
| Co-sharer's spelling slip | Also known as, or rectification deed. No Gazette |
| Ancestor's name differs | Khatiyan form and family tree. No Gazette |
| Name after marriage | Marriage certificate. No Gazette |
| Aadhaar slip | Aadhaar update. No Gazette |
| Genuine change of name | A Central Gazette notice, then each paper |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Partition Deed
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
