Relinquishment Deed Name Mismatch in Jharkhand: Hak Tyag, Heirs and Mutation
A relinquishment deed, also called a release deed or hak tyag patra, is how one heir gives up a share in family property to the other heirs. In Jharkhand it is most often a sister releasing her share in a father's land to her brothers. The deed only works if the papers prove she is an heir: her married name on Aadhaar must tie back to her maiden name in the family tree, and her father's name must match the khatiyan. If they do not, the deed can be registered and still stop at mutation. We publish Gazette notices, and we say this first: a spelling slip in a relinquishment deed needs no Gazette notice.
Five points, in the order you will need them. First, a relinquishment deed can only be made in favour of another heir or co-owner, as reported; for anyone else it is a gift or a sale. Second, prove the releasing person is an heir: the dead owner's name as in the khatiyan, a family tree, and each heir's name as on Aadhaar, with "also known as" where they differ. This is our advice. Third, the deed must be registered, as reported, and once registered it generally cannot be taken back, as reported. Fourth, a slip in a registered deed is fixed by a rectification deed signed by all parties, as reported. Fifth, a spelling slip does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Law Says About a Relinquishment Deed in Jharkhand
We read published legal guides on relinquishment and rectification deeds and reports on Jharkhand stamp duty. These are secondary sources, so each point below is marked as reported. The name advice further down is ours. A relinquishment deed gives up a right for good. Where anyone is unsure, unwilling or under pressure, or the land is tribal, take an advocate.
| Point | What the sources show |
|---|---|
| What it does | One heir or co-owner gives up a share in property, usually inherited, as reported |
| In whose favour | Only another legal heir or co-owner. For an outsider, a gift deed or sale deed is needed, as reported |
| Registration | Compulsory under Section 17 of the Registration Act; an unregistered deed has no legal effect, as reported |
| Taking it back | Generally irrevocable. Cancelled only with all parties' written consent, or by a court for fraud or coercion, as reported |
| Fixing a wrong name | A rectification deed, agreed by all parties and registered at the office of the original deed, as reported |
| Daughters' share | Since the Hindu Succession (Amendment) Act, 2005, a daughter has the same rights as a son in joint family property. Other families follow their own law |
| Stamp duty in Jharkhand | Not confirmed for a relinquishment deed. Ask the sub-registrar |
| CNT and SPT Act land | Some land transfers are restricted. Take an advocate |
So the deed is a promise between heirs, and the sub-registrar and the circle office will ask one question first: is the person releasing really an heir, and is the person receiving really the other heir? The answer lives in the names. This is our reading.
Which Relinquishment Deed Name Mismatch Case You Have
Name problems in a relinquishment deed fall into a few kinds. This sorting is ours, based on the papers families send us.
| What does not match | What it usually is |
|---|---|
| Releasing sister's married name | The family tree has her maiden name; her ID the married name |
| Dead owner's name differs from the khatiyan | The deed used a newer or shorter spelling |
| Father's name differs between heirs | Each brother and sister spells him differently |
| A brother named by a pet name | The family name, not the Aadhaar name |
| Death certificate differs | A slip at the registrar when the owner died |
| Release made to a non-heir | Not a name slip. It may need a gift or sale deed instead |
| A completely different name | A genuine change of name by an heir |
How to Fix Names in a Relinquishment Deed, Before and After Registration
When you fix it decides how hard it is. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Deed not yet registered | Dead owner as in the khatiyan; each heir as on Aadhaar, with "also known as" the family-tree form |
| Sister's married name | Her marriage certificate and an affidavit tie the names. See affidavit after marriage |
| Registered deed, all parties willing | A rectification deed, signed by all. See property registry name correction |
| A party refuses or has died | Court route or that person's heirs. Take an advocate. See succession certificate |
| Death certificate differs | Corrected at the registrar. See death and legal heir certificate |
| Khatiyan itself is wrong | See jamabandi and khatiyan correction |
| Genuine change of name | A Gazette notice, then the deed carries both names |
Before registration, sit with the deed writer and the family tree. Read each name aloud against the khatiyan and that person's Aadhaar. Write the "daughter of" and "wife of" lines for a married sister with care: they are how the circle office knows she is the same heir. Where any heir's names differ, add a one-and-the-same affidavit. The sub-registrar and the circle office decide whether it is enough. This is our advice.
A release gives up a share to the other heirs. If the family wants to divide the land among all of them, a partition deed may suit better. If a living parent wants to pass land on, a gift deed or a will may suit. Which suits your family is a question for an advocate.
Mutation and Later Records After a Relinquishment Deed
After the deed, the heirs who received the share must get it into the land record and every paper built on it. This list is our advice.
| Record | What to watch |
|---|---|
| Mutation in the heirs' names | See dakhil kharij mutation |
| Rent receipt | See online lagan rasid |
| Land possession certificate | See LPC name mismatch |
| Farmer records | See PM-Kisan and farmer registry |
| A later sale or loan | The buyer or bank reads the chain. See encumbrance certificate |
| House tax | See municipal holding tax |
Does a Relinquishment Deed Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a pet name or a maiden name. Those are handled by "also known as", the family tree, an affidavit, or a rectification deed. A Gazette notice is for a genuine change of name, and even then the deed itself is not changed by it.
| Situation | What usually applies |
|---|---|
| Heir's spelling slip | Also known as, or rectification deed. No Gazette |
| Dead owner's name differs | Khatiyan form and family tree. No Gazette |
| Name after marriage | Marriage certificate. No Gazette |
| Aadhaar slip | Aadhaar update. No Gazette |
| Genuine change of name | A Central Gazette notice, then each paper |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Relinquishment Deed
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What a Relinquishment Deed and Its Name Fix Cost in Jharkhand
The costs are small: stamp duty and registration on the release, and more for any rectification deed. Not a Gazette notice, for a slip. We could not confirm the relinquishment deed rate in Jharkhand. Bank and property guides print national figures that do not agree with each other, so we print only the general Jharkhand sale rate, as reported, for comparison.

| Relinquishment deed rate | Not confirmed. Ask the sub-registrar |
| Rectification deed | A registration charge applies, as reported. Ask the sub-registrar |
| Deed writer and advocate | Varies. Agree it in writing |

| Gazette notice | Not needed for a spelling slip. Paid on BharatKosh, revised each year and non-refundable, if ever needed |
