Encumbrance Certificate Name Mismatch in Jharkhand: Buyers, Sellers and Home Loans
An encumbrance certificate (EC) lists the registered transactions on a piece of land or a flat over a period, often 30 years: sales, gifts, partitions and mortgages. A buyer and a home loan bank both read it to check the seller's title. Trouble starts when the seller's name in the EC does not match the seller's Aadhaar, or when an earlier owner appears under two spellings, so the chain looks broken. We publish Gazette notices, and we say this first: a spelling slip in an EC needs no Gazette notice.
Five points, in the order you will need them. First, an EC is not corrected on its own; it copies names from the registered deeds. If a name is wrong in the EC, find which deed carries it. This is our advice. Second, if the EC simply copied a deed correctly and the person's ID differs, tie the two with an affidavit and certified copies. Third, if the deed itself is wrong, it is fixed by a rectification deed. Fourth, if the EC office mistyped a deed, ask the sub-registrar to reissue it against the certified copy. Fifth, a spelling slip does not need a Gazette. We publish Gazette notices, and we say this plainly.
What an Encumbrance Certificate in Jharkhand Shows and Misses
We read a 2026 guide to the encumbrance certificate in Jharkhand and a guide to what an EC shows and misses. Both are secondary sources; the sub-registrar's own practice decides. The name advice further down is ours.
| Point | What the sources show |
|---|---|
| Where to apply | The state's online registration portal, or the sub-registrar office that registered the property, as reported |
| How it is searched | By property: district, block and plot, not by your name, as reported |
| Period | A 30-year search is the usual standard for a Jharkhand purchase, as reported |
| Forms | One form lists the entries found; another shows nil encumbrance, as reported |
| What it shows | Registered sales, mortgages, leases, gifts, partitions and court attachments, as reported |
| What it misses | Unregistered agreements, deposit-of-title-deed mortgages, pending cases, tax dues and possession claims, as reported |
| Old records | Records before about 2004 are not fully digitised; a manual index search may be needed, as reported |
So an EC is a mirror of the deeds. If it shows the seller as "Ramesh Prasad" and his Aadhaar says "Ramesh Prasad Sahu", the EC is not wrong; the deed used a shorter name. The fix is to tie the names, not to argue with the EC. This is our reading.
Which Encumbrance Certificate Name Mismatch Case You Have
Name problems in an EC fall into a few kinds. This sorting is ours, based on the papers buyers and owners send us.
| What does not match | What it usually is |
|---|---|
| Seller's name in EC differs from Aadhaar | The seller's purchase deed used another spelling |
| An earlier owner appears under two spellings | Two deeds, years apart, spelt him differently |
| EC entry differs from the certified deed copy | A typing slip at the EC stage |
| Married woman owner | Bought in her maiden name, ID now in married name |
| Father's name differs | The "son of" line varies across deeds |
| A transaction is missing | Pre-digital records, or an unregistered deal |
| A completely different name | A genuine change of name by an owner |
How to Fix an Encumbrance Certificate Name Mismatch
Find where the slip lives first. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| EC copied a deed correctly; ID differs | A one-and-the-same affidavit by the owner, with certified deed copies |
| EC mistyped a deed | Apply to the sub-registrar with the certified deed copy for a corrected EC |
| The deed itself is wrong | A rectification deed. See property registry name correction |
| Earlier owner under two spellings | Certified copies of both deeds, and an affidavit or heirs' declaration if needed |
| Married woman owner | Marriage certificate and affidavit. See affidavit after marriage |
| Transaction missing | Ask for a manual index search at the sub-registrar, as reported |
| Genuine change of name | A Gazette notice ties old and new names. The deed still shows the old name |
If you are the buyer, ask the seller to sort the name before you pay, not after. A seller who must sign a rectification deed is far easier to reach before the sale than after it. Write it into the agreement: the seller will supply an affidavit or rectification deed before registration. This is our advice.
If you are the owner, the cleanest step is often to tie your names once, with an affidavit and certified copies, and keep that set with your deeds. Then every future buyer and bank sees the answer at once. The bank or buyer decides whether it is enough.
Home Loans, Sales and Mutation After an EC Name Fix
An EC is usually asked for at one of these. This list is our advice.
| Where | What to watch |
|---|---|
| Home loan | See home loan name mismatch |
| Mutation after purchase | See dakhil kharij mutation |
| Land record | See jamabandi and khatiyan |
| Gift in the chain | See gift deed name mismatch |
| Partition in the chain | See partition deed name mismatch |
| Seller acting through an agent | See power of attorney name mismatch |
| Land possession certificate | See LPC name mismatch |
Does an Encumbrance Certificate Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a shorter name or a maiden name. Those are handled by an affidavit, a corrected EC, or a rectification deed. A Gazette notice is for a genuine change of name, and even then the old deeds keep the old name.
| Situation | What usually applies |
|---|---|
| EC typing slip | Sub-registrar reissue. No Gazette |
| Deed spelling slip | Affidavit or rectification deed. No Gazette |
| Name after marriage | Marriage certificate. No Gazette |
| Aadhaar slip | Aadhaar update. No Gazette |
| Genuine change of name | A Central Gazette notice, then each paper |

Central Gazette Process for a Name From Jharkhand, and Where It Fits an Encumbrance Certificate
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What an Encumbrance Certificate and Its Name Fix Cost
The costs are small: the EC fee, certified copies, and an affidavit or rectification deed if needed. Not a Gazette notice, for a slip. The EC fee below is from a secondary guide, as reported; confirm it at the office.

|---|---|
| EC for a 30-year search | About Rs 200 to Rs 500, as reported. Confirm at the office |
| Time | About 1 working day online for a nil EC; 15 to 30 days for a full search at the office, as reported |
| Certified deed copies | As the sub-registrar charges |
| Rectification deed | A registration charge applies, as reported. Ask the sub-registrar |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Gazette notice | Not needed for a spelling slip. Paid on BharatKosh, revised each year and non-refundable, if ever needed |
| What we charge | Quoted on the call. For telling you which paper to fix, nothing |
