Power of Attorney Name Mismatch in Jharkhand: Principal, Agent and Property Papers
A power of attorney (POA) lets one person, the principal, authorise another, the agent, to act for them: sell or manage land, deal with a bank, or collect a pension. Many families in Jharkhand use one when a son works abroad or in another city. Trouble starts when the names do not match: the principal signs abroad in his passport name, while the khatiyan or sale deed carries an older spelling, or the agent is written by a pet name. Then the sub-registrar or bank can stop. We publish Gazette notices, and we say this first: a spelling slip in a POA needs no Gazette notice.
Five points, in the order you will need them. First, in the POA write the principal's name as on the passport or Aadhaar, and add "also known as" the name on the title deed or khatiyan if they differ. This is our advice. Second, write the agent's name as on the agent's Aadhaar. Third, a POA made abroad must be stamped within three months of reaching India, or it can be impounded with a penalty, as reported. Fourth, a POA does not itself transfer land; a registered sale deed does, as the Supreme Court held in 2011, as reported. Fifth, a spelling slip does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Law Says About a Power of Attorney for Jharkhand Property
We read reports on the Supreme Court's 2011 Suraj Lamp judgment and on an Andhra Pradesh High Court ruling of 2022 about POAs made abroad. The name advice further down is ours. A POA for selling land is a serious legal paper. For a sale, a dispute or an elderly principal, take an advocate.
| Point | What the sources show |
|---|---|
| A POA does not sell land by itself | Immovable property passes only by a registered deed of conveyance; an agreement plus GPA plus will does not convey title, the Supreme Court held on 11 October 2011, as reported |
| What a POA can do | Let the agent sign and register a proper sale deed on the principal's behalf, where the POA allows it. This is our reading |
| POA made abroad | Must be stamped within three months of its receipt in India, under Section 18 of the Indian Stamp Act, or it can be impounded and charged a penalty, as reported |
| Late stamping | The authority may collect duty and penalty and then validate it, rather than reject it, as reported |
| When the principal dies | A POA generally ends. The agent can no longer act. This is our reading; ask an advocate |
| Stamp duty in Jharkhand | Not confirmed for each kind of POA. Ask the sub-registrar |
| CNT and SPT Act land | Some transfers are restricted. A POA cannot get round that. Take an advocate |
So the POA is a key, not the house. It must open the right door: its principal must be the same person the title names, and its agent the person who turns up at the sub-registrar. A name that does not tie up stops the key working. This is our reading.
Which Power of Attorney Name Mismatch Case You Have
Name problems in a POA fall into a few kinds. This sorting is ours, based on the papers families send us.
| What does not match | What it usually is |
|---|---|
| Principal's passport name differs from the title | The deed or khatiyan carries an older spelling |
| Surname and given name swapped | The POA was typed abroad in passport order |
| Agent by pet name | The family name, not the Aadhaar name |
| Father's name differs | The "son of" line in the POA and the deed differ |
| Married woman principal | The deed in her maiden name, the POA in her married name |
| Bank account name differs | The bank's KYC uses another spelling |
| A completely different name | A genuine change of name by the principal |
How to Fix a Name in a Power of Attorney
A POA is usually made fresh rather than corrected. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| POA not yet signed | Principal as on passport or Aadhaar, also known as the title name; agent as on Aadhaar |
| POA signed with a wrong name | Usually a fresh POA, cancelling the old one. Ask the sub-registrar or bank if a fresh one is needed |
| Principal abroad | Sign before the Indian mission or as its rules require; stamp within three months of reaching India, as reported |
| Title itself is in an older name | Tie it with a one-and-the-same affidavit, or correct the title. See khatiyan correction |
| Married woman principal | Marriage certificate and affidavit. See affidavit after marriage |
| Principal has died | The POA generally ends. See succession certificate |
| Genuine change of name | A Gazette notice, then a POA naming both names |
For a principal abroad, the safest path is to send the draft from India first, with every name already checked against the title deed and the passport. Then the principal only signs. Write the principal as "A, also known as B, son of C", exactly as the title and passport need. This is our advice. See our name change for NRIs from Jharkhand page if the passport itself needs work.
The sub-registrar or bank decides whether a name gap is acceptable. An affidavit can support the POA; it does not replace a correct one.
Banks, Pensions and Property Deals Using a Power of Attorney
A POA is usually shown at one of these. This list is our advice.
| Where | What to watch |
|---|---|
| Sale of land | See property registry name correction |
| Gift within the family | See gift deed name mismatch |
| Partition among co-sharers | See partition deed name mismatch |
| Mutation | See dakhil kharij mutation |
| Bank account | See bank records |
| Pension | See pension records |
| Overseas job papers | See eMigrate and ECR |
Does a Power of Attorney Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a passport-order name, a pet name or a maiden name. Those are handled by "also known as", an affidavit, or a fresh POA. A Gazette notice is for a genuine change of name, and even then the POA must still be made in both names.
| Situation | What usually applies |
|---|---|
| Principal's spelling slip | Also known as, or a fresh POA. No Gazette |
| Agent's pet name | A fresh POA. No Gazette |
| Name after marriage | Marriage certificate. No Gazette |
| Aadhaar slip | Aadhaar update. No Gazette |
| Genuine change of name | A Central Gazette notice, then each paper |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Power of Attorney
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What a Power of Attorney and Its Name Fix Cost
The costs are small: stamp duty on the POA, any registration, and a fresh POA if one is wrong. Not a Gazette notice, for a slip. We could not confirm the stamp duty for each kind of POA in Jharkhand, so we print no amount.
| Item | What we can and cannot tell you |
|---|---|
| Stamp duty on the POA | Not confirmed for each kind. Ask the sub-registrar |
| POA made abroad | Stamp within three months, or pay a penalty, as reported |
| Mission or notary fee abroad | As the mission or notary charges |
| Drafting | Varies. Agree it in writing |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Gazette notice | Not needed for a spelling slip. Paid on BharatKosh, revised each year and non-refundable, if ever needed |
| What we charge | Quoted on the call. For telling you which paper to fix, nothing |
