Land Acquisition Compensation Name Mismatch in Jharkhand: Land Record, Bank Account and the Law on Who Gets Paid
When land is acquired in Jharkhand for a road, a railway line, a mine or a dam, compensation is paid under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Section 77 of that Act says the Collector pays the "persons interested" by depositing the amount "in their bank accounts". So the name in the land record, the name on the award and the name on the bank account all have to point to the same person. When they do not, the payment can stop, and if there is a dispute about who should receive it, the law sends the money to the Authority instead of to you. We publish Gazette notices, and we say this first: a spelling slip in a compensation claim needs no Gazette notice.
Five points, in the order you will need them. First, put the land record, the award or notice, your bank passbook and your Aadhaar side by side and find the one that differs. Second, if the land record has a spelling slip, get it corrected at the Circle Office or through Parishodhan, early, before the payment stage. Third, if the bank account name differs, correct it at your bank, because the money goes into that account. Fourth, if the land is still in a late parent's name, that is succession, and the heirs must settle their shares. Fifth, if someone disputes who should be paid, Sections 64 and 77 apply, and time limits run from the award. We publish Gazette notices, and a spelling slip here does not need one.
Who Gets Land Acquisition Compensation in Jharkhand, and Why the Name Matters
The points below come from the text of the 2013 Act. Where a point is our own reading, or a news report, we say so.
| Point | What the law says |
|---|---|
| Who is paid | Section 77(1): the Collector pays "the persons interested entitled thereto according to the award" |
| How they are paid | Section 77(1): "by depositing the amount in their bank accounts" |
| When the money is held back | Section 77(2): if there is "any dispute as to the title to receive the compensation or as to the apportionment of it", the Collector deposits it in the Authority |
| If the wrong person is paid | Section 77 keeps the liability of anyone who receives compensation "to pay the same to the person lawfully entitled thereto" |
| Jharkhand's own rules | Jharkhand notified its own rules under the Act in 2015, as listed on India Code. We could not open the rule text, so we quote none of it |
| Where the name comes from | The land record and the survey of holdings. This is our reading from the cases we see |
Which Compensation Name Mismatch You Have
Compensation name problems fall into a few kinds, and each one has a different fix. This sorting is ours, based on the papers people send us.
| What does not match | What it usually is |
|---|---|
| Land record spelling differs from Aadhaar | A slip in Register II or the khatiyan, such as Oraon written as Uraon |
| Bank account name differs from the land record | A short name or old spelling at the bank |
| Land still in a late father or grandfather's name | Land never mutated after a death. The heirs are the persons interested |
| Father's name wrong on the entry | A slip in the parent's name, which matters for heirs |
| A woman's land in her name before marriage | One person with two names |
| Someone else claims the same land | A dispute about who is entitled. Not a name slip |
| Genuine change of name | A deliberate new name, after the land was recorded |
How to Fix a Land Acquisition Compensation Name Mismatch Before Payment
The best time to fix a name is before the award is paid, when it is a simple record correction. After a dispute is raised, it becomes a reference under the Act. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Land record spelling is wrong | Apply to the Circle Officer, or report it on Parishodhan, with your Aadhaar, Class 10 certificate and deed. See jamabandi correction and lagan rasid and Parishodhan |
| Bank account name differs | Correct the name at your branch with your identity papers. See bank records |
| Land in a late parent's name | Heirs settle their shares, then mutation. See legal heir certificate and dakhil kharij |
| Father's name wrong on the entry | Correct it with care, as it traces the heirs. See father name correction |
| Tribal surname written two ways | Correction against your own papers. See Oraon, Uraon and Oram spellings |
| Earlier name before marriage | Marriage certificate and an affidavit. See name change after marriage |
| Two spellings, same person, no time left | Ask the land acquisition office, in writing, whether a one-and-the-same affidavit will do while the correction is pending |
| Someone else claims the land | A dispute for the Authority under Section 64. You need an advocate |
Compensation Disputes in Jharkhand: Section 64 Reference and the Time Limits
If the dispute is about who should be paid, and not just a spelling, the Act gives a route to the Authority. The time limits below are in the Act itself.
| Point | What the Act says |
|---|---|
| What can be referred | Section 64 covers objections to "the person to whom it is payable" and "the apportionment of the compensation among the persons interested", among others |
| If you were present at the award | Apply to the Collector within six weeks from the date of the award |
| If you were not present | Within six weeks of the Collector's notice, or six months from the award, whichever ends first |
| Late application | The Collector may accept it within a further one year if there was sufficient cause |
| The Collector's duty | Refer it to the Authority within thirty days; if not, you may apply to the Authority directly |
| The money meanwhile | Deposited in the Authority under Section 77(2) while the dispute lasts |
Does a Compensation Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a bank name difference or land in a parent's name. Those are fixed in the land record, at the bank, or through succession. A Gazette notice is for a genuine change of name, and even then it does not change the land record or the award by itself.
| Situation | What usually applies |
|---|---|
| Spelling slip in the land record | Circle Office or Parishodhan. No Gazette |
| Bank account name differs | Correction at the branch. No Gazette |
| Land in a late parent's name | Heirs and apportionment. No Gazette |
| Someone else claims the land | A Section 64 reference. No Gazette |
| Genuine change of name | A Central Gazette notice, then Aadhaar, the bank and the land record |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Compensation Claim
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and carry the original Gazette notification to the Circle Office and to the land acquisition office with your application.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What Correcting a Compensation Name Mismatch Costs
The costs of a name correction are small: copies of the land record, perhaps an affidavit. A dispute before the Authority is a different matter, with an advocate.
| Item | What we can and cannot tell you |
|---|---|
| The compensation amount | Set in the award for your land. We print no figure and do not value land |
| Land record correction | No verified fee. Ask at your Circle Office |
| Bank name correction | Usually no charge, but ask your branch |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Succession among heirs | A separate matter, often with an advocate. We print no figure |
| Section 64 reference | An advocate's fee. We do not handle disputes |
| Gazette notice | Only if you choose it for a genuine new name. Paid on BharatKosh, revised each year and non-refundable |
| What we charge | Quoted on the call. For telling you which record to fix, nothing |
