Rent Agreement Name Mismatch in Jharkhand: How to Fix the Tenant or Landlord Name
A rent agreement is a private contract between the landlord and the tenant. No Government office keeps a copy you can edit, unless the lease was registered at a Sub-Registrar office. So the fix depends on one question: was your agreement only signed and notarised, or was it registered? If it was only notarised, both of you sign a fresh agreement or a short correction paper. If it was registered, the correction also has to be registered at the same office. People mostly hit this problem when the agreement is used as address proof for Aadhaar, a passport or a bank, or for a house rent claim at work. We publish Gazette notices, and we say this first: a spelling slip in a rent agreement needs no Gazette notice.
Five points, in the order you will need them. First, find out if your agreement was registered: a registered lease carries the Sub-Registrar's endorsement and a registration number. Second, if it was only notarised, the landlord and the tenant sign a fresh agreement, or a short correction paper, in the right name; this is our advice. Third, if it was registered, the correction paper should also be registered at the same Sub-Registrar office; this is our advice too. Fourth, if the name is right but spelt differently from Aadhaar, a one-and-the-same affidavit often settles it. Fifth, a spelling slip here does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Law Says About Rent Agreements and Lease Registration
Two Central laws decide when a lease must be registered. They apply in Jharkhand as in every State. Where a point is our own reading, we say so.
| Point | What the law or source shows |
|---|---|
| Which leases must be registered | Section 17(1)(d) of the Registration Act, 1908: leases "from year to year, or for any term exceeding one year, or reserving a yearly rent" |
| The same rule in property law | Section 107 of the Transfer of Property Act, 1882 says such a lease can be made only by a registered instrument |
| If a lease that had to be registered was not | Section 49 of the Registration Act: it cannot be used to prove the lease, though it can be used for a side purpose |
| Why most agreements are 11 months | A term of one year or less falls outside Section 17(1)(d), so no registration is compulsory. This is why an 11 month term is so common |
| Where Jharkhand registers leases | At the Sub-Registrar office, using the State's Jharnibandhan online system (jharnibandhan.gov.in) |
| Who keeps an 11 month agreement | Only the landlord and the tenant. No office holds a copy that can be corrected. This is our reading |
Which Rent Agreement Name Case You Have
Rent agreement name problems fall into a few kinds. This sorting is ours, based on the papers people send us. Find your row before you do anything else, because the fix is different for each.
| What does not match | What it usually is |
|---|---|
| Tenant's name spelt wrong | A typing slip by whoever drafted the agreement |
| Tenant's name differs from Aadhaar | Short name, initials, or Hindi to English spelling |
| Father's or husband's name is wrong | A slip in the "son of" or "wife of" line |
| Landlord's name differs from the property papers | The house is in a parent's or spouse's name, not the person who signed |
| A woman tenant's name before marriage | One person with two names |
| Wrong name in a registered lease | A slip that is now part of a registered record |
| Genuine change of name | A deliberate new name, after the agreement was signed |
How to Correct the Name in a Rent Agreement in Jharkhand
We found no published Jharkhand rule on correcting a name in a rent agreement. What follows is how contracts are usually corrected: both parties sign again. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Slip in an 11 month notarised agreement | A fresh agreement in the right name, or a short correction paper on stamp paper, signed by both and notarised. See name spelling correction |
| Name differs from Aadhaar, same person | Often a one-and-the-same affidavit is enough, kept with the agreement |
| Hindi and English spellings differ | Write the name exactly as on Aadhaar in the new paper. See Hindi to English spelling difference |
| Father's or husband's name is wrong | Correct it in the same correction paper. See father's name mismatch |
| Landlord is not the recorded owner | The recorded owner should sign, or give written consent. See property documents |
| Wrong name in a registered lease | A correction deed signed by both and registered at the same Sub-Registrar office |
| Name before marriage | Marriage certificate and an affidavit. See name change after marriage |
| Genuine change of name | A Gazette notice, then Aadhaar, then a fresh agreement in the new name |
For most tenants the easiest route is a fresh agreement. An 11 month agreement ends soon anyway. If yours has only a few months left, many landlords will simply sign a new one in the right name from the next month. This is our advice, and it saves you from carrying two papers.
A correction paper is useful when the agreement has many months left, or when an office has already seen the old one. It should name the date of the old agreement, quote the wrong name, give the right name and say that every other term stays the same. Both parties sign it, with two witnesses, and get it notarised. This format is our advice, not a form from any office.
Rent Agreement as Address Proof: Aadhaar, Passport, Bank and Salary
A name mismatch in a rent agreement usually comes to light when the agreement is shown to some office as proof of address. Each office checks it in its own way. This list is our advice, with the reported rules marked.
| Where it is shown | What to do |
|---|---|
| Aadhaar address update | Guides report that UIDAI accepts a rent or lease agreement where it meets its list. The name must match your Aadhaar. See Aadhaar name change |
| Passport | Guides report a registered rent agreement is preferred. Police may ask for more at verification. See passport name change |
| Police verification of a tenant | The name on the agreement is matched with your ID. See police verification name mismatch |
| Bank account or KYC | Banks match the agreement to your ID. See bank records name change |
| House rent claim at work | Employers usually ask for the landlord's name and, above a yearly rent limit, the landlord's PAN. The landlord's name must match that PAN |
| Electricity or gas in a rented house | These usually stay in the owner's name. Ask the landlord before applying |
Does a Rent Agreement Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a short name or a name before marriage. A rent agreement is a private contract, so the two people who signed it can correct it themselves. A Gazette notice is for a genuine change of name, and even then the agreement still has to be signed again.
| Situation | What usually applies |
|---|---|
| Spelling slip in the agreement | Fresh agreement or correction paper. No Gazette |
| Short name or initials | One-and-the-same affidavit. No Gazette |
| Name before marriage | Marriage certificate. No Gazette |
| Wrong landlord name | The owner signs or consents. No Gazette |
| Genuine change of name | A Central Gazette notice, then Aadhaar, then a fresh agreement |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Rent Agreement
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then sign a fresh rent agreement in the new name, keeping the original Gazette notification with it.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What a Rent Agreement Name Correction Costs in Jharkhand
The costs are small: stamp paper, a notary's fee and perhaps an affidavit. A registered lease costs more, because the correction is registered too. Not a Gazette notice, for a slip.
| Item | What we can and cannot tell you |
|---|---|
| Stamp paper for a fresh agreement | Guides disagree. We print no figure. Use the Jharnibandhan fee calculator or ask the stamp vendor |
| Correction paper | Stamp paper plus the notary's fee. Ask the vendor which value applies |
| Correcting a registered lease | Stamp duty and registration fee as the Sub-Registrar office works out. We found no fixed figure |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Gazette notice | Only if you choose it for a genuine new name. Paid on BharatKosh, revised each year and non-refundable |
| What we charge | Quoted on the call. For telling you which paper you need, nothing |
