RC Hypothecation Removal in Jharkhand: Loan NOC, Form 35 and Name Mismatch
When you close a car or bike loan, the bank's name stays on your RC until you remove it. This is called hypothecation removal or HP termination. The transport office asks for Form 35, signed by you and the financier, with the RC and the bank's NOC. Trouble starts when the names do not match: the NOC spells you one way, the RC another, or your Aadhaar a third. We publish Gazette notices, and we say this first: a spelling slip here needs no Gazette notice.
Five points, in the order you will need them. First, check the name on the bank's NOC against your RC before you leave the bank. Second, if they differ, ask the bank to reissue the NOC in the RC spelling. Third, get Form 35 signed by you and the financier. Fourth, submit it with the RC and the papers your transport office asks. This is our advice. Fifth, a spelling slip here does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Rules Ask to Remove Hypothecation From an RC
We read Section 51 of the Motor Vehicles Act, Form 35 as two State transport departments post it, and one State's list of papers. We could not find Jharkhand's own list for this service, so ask your District Transport Office what it adds. The name fixes further down are our advice.
| Point | What the sources show |
|---|---|
| The law | Section 51 lets the registering authority cancel the loan entry on proof that the agreement has ended |
| The form | Form 35, under Rule 61(1), a notice that the agreement has ended |
| Who signs | The registered owner and the financier |
| What goes with it | The RC and the fee; Form 35 is filed in duplicate |
| What one State adds | Telangana lists the RC, insurance certificate and pollution certificate |
| What the office does | Records the cancellation on the RC and returns the duplicate to the financier |
| Jharkhand's own list and fee | Not found. Ask your District Transport Office |
So three names meet on this file: yours on the RC, yours on the bank's NOC and Form 35, and yours on the ID you show. If any two disagree, the office may stop. Fix or tie them before you apply. This is our reading.
Which Hypothecation Removal Name Mismatch Case You Have
Name problems in hypothecation removal fall into a few kinds. This sorting is ours, based on the papers owners send us.
| What does not match | What it usually is |
|---|---|
| NOC spells you differently from the RC | The bank typed your name from its loan file, not the RC |
| RC has a short form or initials | The dealer typed a short name at registration |
| Aadhaar differs from the RC | A later Aadhaar update, or a married surname |
| Financier's name differs | The bank merged or changed its name after the loan |
| Loan was closed after the owner died | The NOC names the dead owner; the heir must also transfer the RC |
| Insurance in another spelling | Typed from the Aadhaar or the loan file |
| Owner genuinely changed name | A real change after the loan, not carried to the RC |
How to Fix a Name Mismatch in RC Hypothecation Removal
Each paper is corrected by the office that issued it. The transport office removes the loan entry; it does not correct a bank's NOC. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| NOC differs from RC | Ask the bank to reissue it in the RC spelling. See bank records |
| No time to reissue it | An affidavit that both names are the same person |
| RC itself has a slip | See vehicle RC name correction |
| Aadhaar differs | See Aadhaar name change |
| PAN differs | See PAN card name change |
| Married name differs | Marriage certificate and affidavit. See affidavit after marriage |
| Owner has died | Transfer the RC to the heir too. See RC transfer after death |
Start with the bank. If the NOC spells you differently from the RC, write to the branch or the lender's service desk. Attach a copy of the RC and your ID, and ask for a fresh NOC and Form 35 in the RC spelling. If that is slow, swear a one-and-the-same affidavit that the two names are one person, and file it with Form 35. Whether the office accepts it is its decision. This is our advice.
If the bank has merged into another, the NOC may come from the new bank. Keep any merger letter the bank gives you, so the office can see why the financier's name differs from the RC. This is our advice.
Insurance, FASTag and Selling After Hypothecation Removal
Once the bank's name is off the RC, other records must follow. This list is our advice.
| Record | What to watch |
|---|---|
| Motor insurance | Ask the insurer to remove the bank's name at renewal. See health and motor insurance |
| FASTag | See FASTag KYC and RC |
| Driving licence | See driving licence name change |
| Credit report | See CIBIL name mismatch |
| Other loans | See home loan name mismatch |
| PAN and Aadhaar | See PAN and Aadhaar |
Does RC Hypothecation Removal Need a Gazette Notice?
No, for a spelling slip or a short form. Those are fixed at the bank, or tied with an affidavit. A Gazette notice is for a genuine change of name, and removing a bank's name from your RC is not a change of your name at all. It only ends the loan entry.
| Situation | What usually applies |
|---|---|
| NOC spelling slip | Bank reissues it. No Gazette |
| Short form on the RC | Affidavit. No Gazette |
| Aadhaar slip | Aadhaar update. No Gazette |
| Married name | Marriage certificate. No Gazette |
| Owner genuinely changed name | A Gazette notice may help, then the RC name correction |

Central Gazette Process for a Name From Jharkhand, and Where It Fits Hypothecation Removal
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What RC Hypothecation Removal Costs
The costs vary by paper: the transport office fee, perhaps a bank charge for a fresh NOC, perhaps an affidavit. Not a Gazette notice, for a slip. We could not verify Jharkhand's fee for this service, so we print no amount.
| Item | What we can and cannot tell you |
|---|---|
| Fee with Form 35 | Form 35 calls for a fee; as the District Transport Office charges. Ask before you pay |
| Fresh NOC from the bank | As your bank charges, if at all. Ask the branch |
| Aadhaar name update | As UIDAI charges. See our Aadhaar pages |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| New RC card | Ask the office whether a fresh card is printed and what it costs |
| Gazette notice | Not needed for a spelling slip here. Paid on BharatKosh, revised each year and non-refundable, if ever needed |
| What we charge | Quoted on the call. For telling you which paper to fix, nothing |
