Vehicle RC Transfer After the Owner's Death in Jharkhand: Form 31, Death Certificate and Name Mismatch
When a vehicle owner dies, the car, bike or tractor must be moved to the nominee or the heir. Under Rule 56 of the Central Motor Vehicles Rules, as a State transport department sets it out, the person succeeding must tell the registering authority within 30 days of the death and apply in Form 31 within three months, with the death certificate, the RC and the insurance. Trouble starts when the names do not match: the RC spells the owner one way and the death certificate another, or the heir's papers disagree with each other. We publish Gazette notices, and we say this first: a spelling slip in these papers needs no Gazette notice.
Five points, in the order you will need them. First, tell the transport office within 30 days of the death. Second, compare the owner's name on the RC and the death certificate; if they differ, correct the death certificate or tie them with an affidavit. Third, check the heir's own papers agree. Fourth, apply in Form 31 within three months, with the papers your district transport office asks. This is our advice. Fifth, a spelling slip here does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Rules Ask When a Vehicle Owner Dies
We read Rule 56 as set out by a State transport department, the Road Transport Ministry's own year-end review, and another State's document list. We could not find Jharkhand's own list for a transfer on death, so ask your District Transport Office what it adds. The name fixes further down are our advice.
| Point | What the sources show |
|---|---|
| Tell the authority | Within thirty days of the owner's death |
| Use the vehicle meanwhile | The nominee or successor may use it for three months after the death, having told the authority |
| Apply | In Form 31, within three months of the death |
| Papers under the rule | Death certificate, certificate of registration, certificate of insurance, and the fee |
| Nominee | Owners can now name a nominee in the RC, so the vehicle can be transferred to the nominee on death, per the Ministry |
| What another State adds | Odisha asks for an affidavit, legal heir papers and ID proof of all legal heirs |
| Jharkhand's own list | Not found. Ask your District Transport Office |
So two names meet on Form 31: the dead owner's, from the RC and death certificate, and the heir's, from the heir's own ID. If either pair disagrees, the office will stop. Fix or tie them before you apply. This is our reading.
Which RC Transfer Name Mismatch Case You Have
Name problems in a transfer on death fall into a few kinds. This sorting is ours, based on the papers families send us.
| What does not match | What it usually is |
|---|---|
| RC and death certificate spell the owner differently | A slip at the hospital or registrar, or a short form on the RC |
| Death certificate gives a pet name | The name the family used, not the RC name |
| Heir's Aadhaar and PAN differ | A short form, or a married surname |
| Nominee's name on the RC differs | Typed from a different paper at registration |
| Heir's relation not shown | The widow or son is not named on the death certificate |
| Insurance in another spelling | Typed from the RC or Aadhaar |
| Owner had changed name | A genuine earlier change not carried to the RC |
How to Fix a Name Mismatch in an RC Transfer After Death
Each paper is corrected by the office that issued it. The transport office transfers the RC; it does not correct a death certificate. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Death certificate differs from RC | Correct it at the registrar. See death and legal heir certificate |
| No time to correct it | An affidavit by the heir that both names are the same person |
| Several heirs, no nominee | Ask the office what it needs; some States ask for affidavits and ID of all heirs. See succession certificate |
| Heir's Aadhaar differs | See Aadhaar name change |
| RC itself has a slip | See vehicle RC name correction |
| Widow's name differs across papers | Marriage certificate and affidavit. See affidavit after marriage |
| Owner had a genuine earlier name change | The old Gazette notice, if any, ties the names |
Start with the death certificate. If it spells the owner differently from the RC, ask the birth and death registrar to correct it, with the owner's Aadhaar, PAN or other ID. If the three-month limit is close, swear a one-and-the-same affidavit that the two names are one person, and file it with Form 31. Whether the office accepts it is its decision. This is our advice.
Where there is no nominee and more than one heir, the office will want to know who takes the vehicle. Some States, like Odisha, ask for an affidavit and ID proof of all legal heirs. Ask your District Transport Office for its list in writing before you gather papers. This is our advice.
Insurance, Vehicle Loan, FASTag and Selling After the RC Transfer
Once the RC is in the heir's name, other records must follow. This list is our advice.
| Record | What to watch |
|---|---|
| Motor insurance | Move it to the heir's name. See health and motor insurance |
| FASTag | See FASTag KYC and RC |
| Vehicle loan | If the vehicle is financed, the lender's consent is needed. See vehicle RC name correction |
| Driving licence | See driving licence name change |
| Bank claims by the nominee | See nominee name mismatch |
| Other assets | See shares and mutual funds for heirs |
Does an RC Transfer After Death Need a Gazette Notice?
No, for a spelling slip or a short form. Those are fixed at the registrar, or tied with an affidavit. A Gazette notice is for a genuine change of name, and an RC transfer on death is not a change of name at all. It is a change of owner.
| Situation | What usually applies |
|---|---|
| Death certificate slip | Registrar correction. No Gazette |
| Short form on the RC | Affidavit. No Gazette |
| Heir's Aadhaar slip | Aadhaar update. No Gazette |
| Widow's married name | Marriage certificate. No Gazette |
| Owner had genuinely changed name | The old Gazette notice, if one was made |

Central Gazette Process for a Name From Jharkhand, and Where It Fits an RC Transfer After Death
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and residence papers, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What an RC Transfer After Death Costs
The costs vary by paper: the transfer fee, perhaps a death certificate correction, perhaps an affidavit. Not a Gazette notice, for a slip. We could not verify Jharkhand's transfer fee, so we print no amount.
| Item | What we can and cannot tell you |
|---|---|
| Transfer fee with Form 31 | The rules call for a fee; as the District Transport Office charges. Ask before you pay |
| Death certificate correction | As the birth and death registrar charges |
| Heir's Aadhaar update | As UIDAI charges. See our Aadhaar pages |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Late intimation | Ask the office whether a fine applies if you pass the time limits |
| Gazette notice | Not needed for a transfer on death or a spelling slip. Paid on BharatKosh, revised each year and non-refundable, if ever needed |
| What we charge | Quoted on the call. For telling you which paper to fix, nothing |
