Gratuity Nomination and Claim Name Mismatch in Jharkhand: Form F, Form J and Form K
Gratuity is paid by the employer, and the Payment of Gratuity (Central) Rules, 1972 set out one form for each step. The nomination is on Form F, a change to it on Form H, and the claim on Form I, J or K depending on who claims. When the name in the nomination or the service record does not match Aadhaar, the bank account or the death certificate, the payment can be held up. Most of these mismatches are fixed with documents, and while the employee is alive, with a fresh Form H. A Gazette notice is usually not needed. We publish Gazette notices, and we say this first.
Five points, in the order you will need them. First, check the name in your Form F nomination now, while you are still working; a wrong name is fixed with Form H. Second, if you married after nominating, the Rules ask for a fresh nomination on Form G within ninety days of acquiring a family. Third, after the employee's death, the nominee claims on Form J and links any different name with a marriage certificate or an affidavit. Fourth, with no valid nomination, a legal heir claims on Form K with evidence. Fifth, if the employer rejects the claim on Form M, you can apply on Form N to the controlling authority. We publish Gazette notices, and we say plainly that most of these cases need none.
Gratuity Forms F, G, H, I, J and K: Where Each Name Is Written
Rule 6 says a nomination "shall be in Form `F' and submitted in duplicate by personal service by the employee, after taking proper receipt or by sending through registered post acknowledgement due to the employer". It must be signed "in the presence of two witnesses". Rule 7 then gives one claim form for each kind of claimant.
| Form | What it is, and whose name is on it |
|---|---|
| Form F | The nomination. The employee's name and each nominee's name |
| Form G | A fresh nomination by an employee who has acquired a family |
| Form H | A modification of the nomination |
| Form I | The employee's own claim |
| Form J | The nominee's claim |
| Form K | The legal heir's claim |
Which Gratuity Name Mismatch You Have
Gratuity name problems usually fall into a few kinds. This sorting is ours, built from the forms the Rules prescribe.
| What does not match | What it usually is |
|---|---|
| Employee's name: service record against Aadhaar or bank | Often a spelling slip made when the employee joined |
| Nominee's name in Form F against the nominee's Aadhaar | Often a short name, a nickname, or a daughter's married surname |
| Wife recorded by her maiden name | A surname change after marriage |
| Deceased's name: death certificate against service record | Often a slip on the death certificate |
| No valid nomination at all | Not a name problem; legal heirs claim on Form K |
How to Fix Each Name Mismatch in a Gratuity Nomination or Claim
The best time to fix a gratuity name is while the employee is still working, because then a simple Form H does it. This is our practical advice, since the Rules give the forms but not how to reconcile names.
| Mismatch | What usually fixes it |
|---|---|
| Nominee's name wrong, employee alive | Form H, with the nominee's name exactly as on Aadhaar |
| Employee married after nominating | Form G, within ninety days of acquiring a family |
| Employee's own name slip in service record | HR correction with Aadhaar, the school certificate and an affidavit. See spelling correction affidavit |
| Nominee's name differs, employee has died | A marriage certificate or a one-and-the-same affidavit with Form J |
| Death certificate misspelt | Registrar correction. See death certificate correction |
| Genuine change of name by the employee | A Central Gazette notice, then Aadhaar, PAN, the bank and HR |
Gratuity Claim by Legal Heirs, and What to Do if the Employer Rejects It
With no valid nomination, a legal heir claims on Form K, "ordinarily within one year from the date of gratuity became payable". Form K asks for the "Date of death of the employee and evidence/witness in support thereof" and the "Basis of the claim and evidence/witness in support thereof". Names on that evidence must match too.
| Step | What the Rules say |
|---|---|
| Employee or nominee applies | "ordinarily within thirty days" of gratuity becoming payable |
| Legal heir applies | "ordinarily within one year" |
| Late application | "shall also be entertained by the employer, if the applicant adduces sufficient cause for the delay" |
| Employer's reply | Within fifteen days: Form L if admissible, Form M with reasons if not |
| Payment date in Form L | "not being later than the thirtieth day after the date of receipt of the application" |
| Rejected, underpaid or no reply | Form N to the controlling authority, "within ninety days", with late filing allowed on sufficient cause |
Does a Gratuity Name Mismatch Need a Gazette Notice?
Usually not. The Rules name no Gazette notice anywhere. While the employee is alive, Form H corrects a nominee's name. After death, a marriage certificate or an affidavit usually links a nominee's two names, and the Registrar corrects a death certificate.
| Situation | What usually applies |
|---|---|
| Nominee's name wrong, employee alive | Form H. No Gazette |
| Married nominee | Marriage certificate. No Gazette |
| Death certificate slip | Registrar correction. No Gazette |
| Employee genuinely changed name | A Central Gazette notice is the clean route for HR |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Gratuity Claim
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, then the bank, and give the notice to HR for the service record and gratuity.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What Fixing a Gratuity Name Mismatch Costs
The Rules do not name a fee for a nomination, a modification or a claim. The costs are the documents that prove the name, and usually not a Gazette notice.
| Item | What we can and cannot tell you |
|---|---|
| Form F, G, H or the claim form | No fee named in the Rules |
| Affidavit | Stamp paper, Rs 100 as our safe default, plus the notary's fee |
| Death certificate correction | Set by the Registrar. Ask for a receipt |
| Legal heir or succession certificate | Set by the authority or court. We print no figure |
| Gazette notice | Usually not needed. If it is, the charge is paid on BharatKosh, is revised each year and is non-refundable |
| What we charge | Quoted on the call. For telling you which paper fixes it, nothing |
