Gold Loan Name Mismatch in Jharkhand: KYC, Ownership Declaration and Getting Your Gold Back
A gold loan looks simple: you hand over jewellery and get money the same day. But your name is checked in three places. First, the lender's KYC, against your Aadhaar and PAN. Second, the ownership declaration: the RBI's 2025 gold loan Directions say a lender must take "a suitable document or declaration" that you are the rightful owner, which matters when the jewellery bill is in your mother's name or your name before marriage. Third, when the gold is returned, to you or, if you have died, to your legal heirs. Match these names at the start, and getting your gold back is easy. We publish Gazette notices, and we say this first: a spelling slip in a gold loan needs no Gazette notice.
Five points, in the order you will need them. First, match Aadhaar and PAN before you pledge, because the lender's KYC checks both. Second, if the jewellery bill is in another name, say so in the ownership declaration, with your relationship to that person; this is our advice. Third, check your name on the pledge receipt the day you take the loan. Fourth, if the borrower has died, the heirs' names must match the death and legal heir papers. Fifth, a spelling slip here does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the RBI Gold Loan Directions of 2025 Say
The Reserve Bank of India issued the (Lending Against Gold and Silver Collateral) Directions, 2025 on 6 June 2025. They apply to banks and other regulated lenders. Where a point is our own reading, we say so.
| Point | What the Directions say |
|---|---|
| When they apply | Paragraph 3: to be followed "no later than April 1, 2026" |
| Ownership | Paragraph 13: "A suitable document or declaration shall be obtained from the borrower in all cases to the effect that the borrower is the rightful owner" |
| Loan to value | Paragraph 19: up to 85% for loans up to Rs 2.5 lakh, 80% above Rs 2.5 lakh to Rs 5 lakh, 75% above Rs 5 lakh |
| Returning the gold | Paragraph 35: to "the borrower(s)/ legal heir(s)" on the same day, and not more than seven working days after full repayment or settlement |
| Delay | Paragraph 46: the lender pays Rs 5,000 for each day of delay beyond that |
| KYC | Paragraph 52: lenders follow the Master Direction on KYC, 2016 |
Notice that paragraph 35 names legal heirs as well as the borrower. So when a borrower dies, the gold goes back to the heirs, and the heirs' names become the ones that must match. This is our reading. The Directions do not set out a separate heirs' procedure, so each lender uses its own.
Which Gold Loan Name Case You Have
Gold loan name problems fall into a few kinds. This sorting is ours, based on the papers families send us.
| What does not match | What it usually is |
|---|---|
| Aadhaar differs from PAN | Initials on one, full name on the other |
| Jewellery bill in another name | Bought by a parent, or in your name before marriage |
| Name wrong on the pledge receipt | A typing slip at the branch |
| Borrower has died | Heirs' names must match their papers |
| Someone else collecting the gold | An authorisation question, not a name error |
| A woman borrower's name before marriage | One person with two names |
| Genuine change of name | A deliberate new name, while the loan is running |
How to Fix a Gold Loan Name Mismatch
We found no RBI rule on name mismatches in a gold loan. What follows is how families usually handle them. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Aadhaar differs from PAN | Correct whichever is wrong. See PAN name change and Aadhaar name change |
| Jewellery bill in a parent's name | Say so in the ownership declaration, with your relationship to that person |
| Bill in your name before marriage | Show the marriage certificate. See name change after marriage |
| Name wrong on the pledge receipt | Ask the branch to correct it in writing the same day |
| Borrower has died | Heirs' papers first. See death and legal heir certificate |
| Two spellings, one person | A one-and-the-same affidavit may help |
| Genuine change of name | A Gazette notice, then Aadhaar and PAN, then tell the lender |
The ownership declaration is where most families in Jharkhand hit a name problem. Much household gold was bought years ago, often by a parent, and the bill is lost or in someone else's name. The RBI accepts a declaration in place of a document. Write it truthfully: say whose gold it was, how it came to you, and that it is not pledged anywhere else. This is our advice.
Check the pledge receipt before you leave the branch. Your name, the weight and the purity should all be right. A slip on this receipt is easy to fix on day one and hard to fix when you come to take the gold back. This is our advice.
Getting Your Pledged Gold Back: Borrower, Family Member or Legal Heirs
The RBI rule is clear on timing. Who can collect depends on who you are. This list is our advice, with the RBI and reported points marked.
| Who collects | What to take |
|---|---|
| The borrower | The pledge receipt and the same ID used at KYC |
| A family member for a living borrower | An authorisation or power of attorney, as the lender accepts, as reported |
| Legal heirs | Death certificate and heirship papers, with each heir's ID, as reported. See succession certificate |
| A named nominee | See nominee name mismatch |
| Time limit | Seven working days after full repayment, per RBI paragraph 35 |
| If it is late | Rs 5,000 a day, per RBI paragraph 46 |
Does a Gold Loan Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a bill in a parent's name, or a name before marriage. Those are handled with Aadhaar, PAN, the ownership declaration and a marriage certificate. A Gazette notice is for a genuine change of name, and even then the lender still needs to be told.
| Situation | What usually applies |
|---|---|
| Slip on the pledge receipt | Branch correction. No Gazette |
| Jewellery bill in a parent's name | Ownership declaration. No Gazette |
| Name before marriage | Marriage certificate. No Gazette |
| Borrower has died | Heirs' papers. No Gazette |
| Genuine change of name | A Central Gazette notice, then Aadhaar and PAN, then the lender |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Gold Loan
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then tell your gold loan lender, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
