Cheque Payee Name Mismatch in Jharkhand: When the Name on a Cheque Differs From Your Bank Account
You receive a cheque, say a refund, a claim or a payment from a buyer, and the payee name on it is spelt differently from your bank account name. Or you changed your name, and the cheque still carries the old one. Most cheques today are crossed "account payee", and the RBI has long said banks may not credit such a cheque "to the account of any person other than the payee named therein". So a bank can refuse or return a cheque whose payee name does not match the account. The fix is usually a fresh cheque in your account name, or updating your account name first. We publish Gazette notices, and we say this first: a spelling slip on a cheque needs no Gazette notice.
Five points, in the order you will need them. First, compare the payee name on the cheque with your account title letter by letter. Second, if the difference is small, ask your branch whether it will accept the cheque; this is our advice. Third, if it will not, ask the person who issued it for a fresh cheque in your exact account name, before the cheque is three months old. Fourth, if your name has changed, update your account name and get a new cheque book. Fifth, a spelling slip here does not need a Gazette. We publish Gazette notices, and we say this plainly.
What the Rules Say About Account Payee Cheques and Payee Names
The points below come from an RBI circular on account payee cheques and a guide to cheque return codes. Where a point is our own reading, we say so.
| Point | What the source shows |
|---|---|
| Account payee cheque | Banks are "prohibited from crediting 'account payee' cheque to the account of any person other than the payee named therein", per an RBI circular of 7 September 2009 |
| Where it is repeated | The RBI's Master Circular on Customer Service in Banks, 1 July 2014, carries a paragraph on the same prohibition |
| Return reasons for names | Codes for "Title of account required" and "Title of account wrong/incomplete" are listed among cheque return reasons, as reported |
| Signature reasons | "Drawer's signature differs" is a separate return reason, as reported |
| Alterations | A change on the cheque needs the drawer's authentication, as reported |
| Validity | A cheque is valid for three months from its date |
So the bank's question is simple: is the account you want to credit the account of the payee named on the cheque? A tiny difference, such as a missing middle name, may still be accepted by your branch. A clearly different name may not. This is our reading; each bank decides its own cases.
Which Cheque Name Case You Have
Cheque name problems fall into a few kinds. This sorting is ours, based on the cases people bring us.
| What does not match | What it usually is |
|---|---|
| Payee name spelt slightly differently | A slip by the person who wrote the cheque |
| Payee name in your old name | You changed your name, the payer did not know |
| Your account title itself is wrong | A slip when the account was opened |
| Cheque in a late parent's name | Not a name error; a claim by heirs |
| Your own cheque book shows an old name | Account updated, cheque book not reissued |
| Your signature has changed | Specimen signature not updated |
| Genuine change of name | A deliberate new name, with cheques still coming in the old one |
How to Deposit a Cheque When the Payee Name Does Not Match
We found no RBI rule that sets how close a payee name must be. What follows is how these cases are usually handled. The table below is our practical advice.
| Situation | What we usually advise |
|---|---|
| Small spelling difference | Ask your branch before depositing; some accept with your ID |
| Clearly different name | Ask the payer for a fresh cheque in your exact account name |
| Cheque in your old name | Ask the payer for a fresh cheque, and tell them your new name. See name change after marriage |
| Your account title is wrong | Correct it at the branch. See name change letter to bank manager |
| Cheque in a late parent's name | A claim by heirs. See nominee and bank claims |
| Two spellings, one person | A one-and-the-same affidavit may help the branch |
| Genuine change of name | A Gazette notice, then update the account, then tell payers |
When you ask for a fresh cheque, send the payer your name exactly as on your passbook, in writing. Many refunds and claims are paid by organisations, not people, and they copy the name from their own records. If their record is wrong, ask them to correct it too, or the next cheque will repeat the mistake. This is our advice.
Watch the date. A cheque is valid for three months. If the fresh cheque will take time, ask for it early, and ask whether the payer can send the money by bank transfer instead, which checks the account number, not the spelling. This is our advice.
Your Own Cheque Book, Signature and Payments After a Name Change
If your own name has changed, your cheque book and signature need attention too. This list is our advice.
| Record | What to do |
|---|---|
| Cheque book | Ask for a new one printed with your updated account name |
| Specimen signature | Update it if you now sign differently. See signature change after name change |
| Old cheques already issued | They still work if the signature matches. Tell payees if needed |
| Income tax refund | Paid by bank transfer to a validated account. See income tax refund |
| A bank refusing your Gazette | See bank not accepting a Gazette |
| PAN and Aadhaar | The base for your account name. See PAN and Aadhaar |
Does a Cheque Payee Name Mismatch Need a Gazette Notice?
No, for a spelling slip, a short name or a name after marriage. Those are fixed by a fresh cheque or an account update. A Gazette notice is for a genuine change of name, and even then the payer still has to write a fresh cheque.
| Situation | What usually applies |
|---|---|
| Payee name spelt wrong | A fresh cheque. No Gazette |
| Your account title wrong | Branch correction. No Gazette |
| Cheque in your name before marriage | A fresh cheque or marriage certificate. No Gazette |
| Signature changed | New specimen signature. No Gazette |
| Genuine change of name | A Central Gazette notice, then the account update, then fresh cheques |

Central Gazette Process for a Name From Jharkhand, and Where It Fits a Cheque
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes and download the e-Gazette copy. Then update Aadhaar and PAN, and then your bank account and cheque book, with the original Gazette notification.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
