Gender Change in Documents in Jharkhand
Two things about this subject are almost always confused, and getting them apart saves most of the cost and most of the difficulty. Changing the gender recorded in your documents and changing your name are two separate jobs with two separate instruments. For the gender entry, the law provides a certificate of identity issued by the District Magistrate, and the Act says the gender "shall be recorded in all official documents in accordance with certificate issued." The Aadhaar's own procedure asks for a certificate too, and names no gazette notification for a gender update at all. The gazette enters only where the first name is also changing. One more thing you must know before acting: this law was amended in 2026 and the amendment has been challenged in the Supreme Court, so the section below tells you exactly what we could verify and what you must confirm yourself.
The gender entry in your documents is governed by a statute, and the statute names a certificate rather than a gazette. Under the Transgender Persons (Protection of Rights) Act, 2019, an application goes to "the District Magistrate for issuing a certificate of identity as a transgender person", and where a minor is concerned "such application shall be made by a parent or guardian." The Act then provides that "The gender of transgender person shall be recorded in all official documents in accordance with certificate issued." The Aadhaar's own published procedure follows the same shape. For a gender update it asks for a "medical certificate having photograph issued by surgeon or concerned Authority", and where the update records transgender status it says "the resident will be required to submit a certificate issued by the Central/State Govt as POI document." It names no gazette notification for a gender update. The gazette comes in only when the first name is changing as well, which is a separate job. And before you act on any of this, read the section on the 2026 amendment, because the framework was changed and the change has been challenged.
Why a Gender Entry and a Name Are Two Separate Changes in Your Documents
Almost everyone arrives treating this as a single change, and consultants often sell it as one. It is two, and they are governed by different things.
| The gender entry | The name |
|---|---|
| Governed by a statute. The Transgender Persons (Protection of Rights) Act, 2019 provides for a certificate of identity issued by the District Magistrate | Governed by the ordinary documentary route, which is an undertaking, a newspaper advertisement and a gazette notification where a record asks for one |
| The Act states that the gender "shall be recorded in all official documents in accordance with certificate issued" | No such sentence exists for a name. Each office names its own document, and the lists do not agree with each other |
| The Aadhaar procedure names a certificate, not a gazette, for a gender update | The Aadhaar supporting list names a gazette notification for a change in first name or full name |
| The instrument is issued by a Government office on an application by you | The instrument is made by you and published, which is a different kind of thing entirely |
| You may need only this, if your name is staying as it is | You may need only this, if your gender entry is already correct |
| And the common case | Both, in order. The certificate first, because the Act ties the record to it, and the name route afterwards for the offices that ask for a gazette |
The Certificate of Identity From the District Magistrate, and What the Act Says
This subject has a statute behind it, which most name change subjects do not. Here is what the Act provides, quoted, and the section that matters most to a reader is the one about records.
| The provision | What it says and what it means in practice |
|---|---|
| Where the application goes | To "the District Magistrate for issuing a certificate of identity as a transgender person". Your own district office in Jharkhand, not Delhi and not a private desk |
| Who applies for a minor | The Act provides that "such application shall be made by a parent or guardian" of the child. Shall, not may |
| What the District Magistrate issues | "The District Magistrate shall issue to the applicant under section 5, a certificate of identity as transgender person", following the prescribed procedure |
| The sentence that matters most to your records | "The gender of transgender person shall be recorded in all official documents in accordance with certificate issued." This is a statutory entitlement, not a request, and it is the sentence to carry with you |
| Where a change to male or female is concerned | The Act deals separately with a person who undergoes surgery, providing for an application with medical documentation and a revised certificate from the District Magistrate indicating the change in gender |
| And the name entitlement that comes with it | A person holding such a certificate is entitled to "change the first name in the birth certificate and all other official documents relating to the identity of such person". The first name, expressly |
| What this all adds up to | The certificate is the instrument. An office that has been shown a certificate and still refuses is refusing something the statute provides for, and the right response is a written request quoting the section, not buying a different paper |
The 2026 Amendment to the Act and What You Must Confirm Yourself
We are going to be unusually careful here, because this is the one subject on this website where the law moved recently, the change is significant, and it has been challenged. What follows is what we could verify and what we could not.
| The point | What we found |
|---|---|
| An amending Act exists | The Transgender Persons (Protection of Rights) Amendment Act, 2026 was published by the Ministry of Law and Justice, Legislative Department, and we have read that text |
| It introduces a medical board | It defines an "Authority" as "a medical board, headed by a Chief Medical Officer or a Deputy Chief Medical Officer, as may be appointed by the Central Government, State Government or Union territory Administration." |
| It changes how the certificate is issued | The District Magistrate is to examine "the recommendation of the authority and, if he considers either necessary or desirable, after taking the assistance of other medical experts." That is a different procedure from the one described above |
| It changes the definition | The amended definition turns on socio cultural identities and on intersex variations, and it expressly excludes "persons with different sexual orientations and self-perceived sexual identities." We are printing what it says and we are not going to tell you which side of it you fall |
| It makes one application mandatory | In the provision dealing with a change of gender it replaces "such person may" with "such person shall", and it adds a reporting duty on medical institutions to the District Magistrate and the authority |
| When it came into force | 25 May 2026. India Code, the Government's own statute database, now carries the amended Act with the footnotes "Omitted by Act 3 of 2026, s.3 (w.e.f. 25-05-2026)" and "Subs. by Act 3 of 2026, s.7, for s.18 (w.e.f. 25-05-2026)" against the changed provisions. It is Act No. 3 of 2026, and it is in force |
| The provision that was deleted outright | The right to self perceived gender identity. India Code shows sub-section (2) of section 4 as omitted with effect from 25 May 2026. Section 4 now reads only that "A transgender person shall have a right to be recognised as such, in accordance with the provisions of this Act." This is the single biggest change and almost no page anywhere mentions it |
| A new duty on the hospital, not on you | A new sub-section provides that the medical institution "shall furnish the details of such person to the concerned District Magistrate and the authority in such form and manner as may be prescribed." The reporting obligation sits with the institution |
| What is still unresolved, and we say so | The amendment is under challenge in the Supreme Court and has not been stayed. We could not verify from a Government source that the rules setting out the medical board's composition and procedure have been notified. Until they are, what a district office actually does is a question of fact, not of text |
| What that means for you | Ask the District Magistrate's office in your own district what procedure it is following today, before you spend anything or submit anything. Ask in writing and keep the reply. The statute is settled; the practice under it is not, and their answer for today outranks this page |
The National Portal for Transgender Persons, and Why It Costs Nothing
Consultant pages on this subject sell a gazette file. The Government runs a national portal for exactly this application, and its own frequently asked questions answer the two things people most want to know.
| The question | What the portal itself answers |
|---|---|
| What does it cost | "No. The application process is free of cost." That is the portal's own answer, in its own words. Anybody quoting you a Government fee for this certificate is quoting something the Government says does not exist |
| How long does it take | "The time taken for processing the application depends on the verification process followed by district up to a maximum of 30 Days." A published outer limit, which is rare in this subject |
| Who actually issues it | The portal names District Collectors and Magistrates, which matches the Act. Your own district, as the rest of this page says throughout |
| Is surgery required | The portal's definition covers a person "whether or not such person has undergone Sex Reassignment Surgery or hormone therapy or laser therapy or such other therapy." Read that against the amended definition in the section above, because the two sit uneasily together and we are not going to pretend otherwise |
| Can it be done online | Yes. The portal takes an application online through applicant registration, so a first application need not begin with a queue at an office |
| The honest caveat | The portal's public material still describes the position before the 2026 amendment, including the self declaration language. We are telling you what it says and when it was written, rather than treating it as today's procedure, which is why the written question to your district office still comes first |
What the Aadhaar Procedure Asks For on a Gender Update
For most readers the Aadhaar is the record that unlocks everything else, so it is worth knowing exactly what its own published procedure names. It is not what this website mostly sells.
| The point | What the published procedure says |
|---|---|
| For a gender update generally | The resident is "to submit a medical certificate having photograph issued by surgeon or concerned Authority as POI document." |
| Where the update records transgender status | "the resident will be required to submit a certificate issued by the Central/State Govt as POI document." Which is the certificate of identity the Act provides for |
| What it does not name | No gazette notification. The gazette requirement in that same document belongs to a complete change of name, which is a different update |
| And what the Authority publishes when a repeat update is refused | Where a gender update is rejected because the limit is crossed, the Authority names an exception route and states the documents to send as "EID slip of latest enrolment, alongwith Medical Certificate/Transgender id card", with 1947 as the number to call. Your transgender identity card is expressly named there, which is the clearest practical reason to get the certificate first |
| There are limits on how many times | The procedure refers to "restrictions on number of Gender update". We could not read the exact number in the text available to us, so we are not going to state one. Treat it as limited and get it right once |
| What is certain about the name side | The same procedure states that the name "can be updated twice in a lifetime", and that requests beyond that go through an exception process. So if the first name is also changing, settle it completely before the visit |
| And the timing to plan around | The Authority states that an update takes up to 90 days. Do not book anything that depends on it finishing sooner. Our timeline page sets out every published clock |
Where a Gazette Notification Does and Does Not Come Into a Gender Change
We file gazette notices for a living, so read this section knowing that. It tells you that for a large part of this subject you do not need us.
| Your situation | Whether a gazette is part of it |
|---|---|
| Only the gender entry is changing | The gazette route is not the instrument. The Act provides for a certificate from the District Magistrate, and the Aadhaar procedure asks for a certificate. Nothing in either names a gazette for this |
| The first name is changing as well | Here it may enter. The Aadhaar supporting document list names a gazette notification for a change in first name or full name, and the Act itself speaks of an entitlement to change the first name in official documents |
| A spelling is simply wrong and nothing was ever changed | A correction against the office's own original entry, needing none of this. Our correction against change page is the test |
| An office is demanding a gazette for the gender entry itself | Ask, in writing, which provision requires it. Take the certificate and the Act's own sentence about records with you. Sometimes the answer is a real internal circular, and then you comply, but ask first |
| The Department does publish a gender related format | Its document list includes a Format of Undertaking or Affidavit for change of Gender. We were not able to read that document's contents while writing this page, so we quote nothing from it. It exists, and it is worth asking about if a gazette file is genuinely required in your case |
| What we will actually do for you | Read your records, tell you whether this is one job or two, help with the written request to your District Magistrate's office, and file a gazette only where a named record genuinely asks for one. Where the certificate is the whole answer, we will say so and charge you nothing |
How to Change a Gender Entry and Name in Documents in Jharkhand
Ask Your District Magistrate's Office What Procedure Applies Today
In writing, and keep the reply. The Act was amended in 2026 and the amendment has been challenged, so the procedure being followed in your district this month is a question of fact that only that office can answer. This step is free and it comes before everything.
Work Out Whether This Is One Change or Two
The gender entry, the name, or both. They are separate jobs with separate instruments, and a desk that quotes you one price without asking this has not understood your situation.
Apply for the Certificate of Identity in Your Own District
The Act directs the application to "the District Magistrate for issuing a certificate of identity", and where a minor is concerned "such application shall be made by a parent or guardian." This is the instrument the rest of the job rests on.
Keep Certified Copies and a Dated Acknowledgement of Everything
Of the application, of anything handed over, and of the certificate itself. You will be asked for this document repeatedly for years, by offices that will not return your original.
Settle the Name Completely Before Any Record Is Touched
If a name is changing as well, decide it letter by letter including spelling, spacing and initials. The Aadhaar name can be updated twice in a lifetime, and the gender update has its own stated restrictions, so both should be done once and correctly.
Update the Aadhaar With the Certificate the Procedure Names
Its published procedure asks for a medical certificate with photograph for a gender update, and where transgender status is recorded, a certificate issued by the Central or State Government. Allow up to 90 days and do not book anything that depends on it being faster.
Take the Act's Own Sentence to Every Other Office
Printed. "The gender of transgender person shall be recorded in all official documents in accordance with certificate issued." A quoted provision is treated differently from a remembered one, and a written request with a dated acknowledgement moves more files than any argument at a counter.
Do the Records in an Order That Does Not Send You Backwards
Certificate, then Aadhaar, then PAN, then banks, then educational records and employment, then passport and everything else. Correct the PAN rather than applying for a second one, because obtaining multiple PAN is a listed default.
Ask in Writing If an Office Refuses or Goes Silent
Naming the provision you rely on and asking which provision adds the requirement. A written request to a public authority is to be answered within 30 days in the normal course, with a first appeal after that.
The Full Central Gazette Process, for the Name Side of This Job Only
No district in Jharkhand has a gazette counter, so a genuine file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.
The Eight Steps of a Name File Sent From Jharkhand
Settle the final name first
Letter by letter, with the spacing you want, and then use exactly that everywhere, Aadhaar included. A corrigendum after publication is a second fee and a second wait.
Pick the category, then its proforma
A genuine change of name is change of Name Adult or Major. A wrongly typed spelling is the public notice for a wrongly written name. Twelve categories exist and only one is yours.
Type the proforma in duplicate
Two originals with two witnesses giving signature, full name, address and mobile number on both copies. A change of name is signed in the old name; a public notice is signed in your own name.
Fill the employment field if it is a change of name
The adult proforma asks for the post of the applicant and the office or company name. A student or a homemaker should still complete it rather than leaving it blank, because a blank field brings the file back.
Publish and keep the original paper
One of the daily local leading newspapers, carrying both names in full, the father or husband name and the residential address. The whole original paper goes in the file, not a cutting.
Pay only through BharatKosh
The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.
Check every date, then post it yourself
Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.
Read the notice, then update in the right order
Check every word the day it publishes, because a published gazette is not edited and a mistake needs a fresh corrective process. Download the e-Gazette copy, which is free, then take the records in order: the Aadhaar first, carrying both the certificate and the notification as the procedure requires, then the PAN, which is corrected and never replaced, then banks, educational records and employment, taking a dated acknowledgement at every single office.
The Five Papers in the File, and What Is Checked in Each
| The paper | What is checked in it, clause by clause |
|---|---|
| 1. The proforma, in duplicate | That it is the right category format; the existing full name exactly as your documents carry it; the new full name exactly as settled; the father or husband name; the full address with pin code; the post and office or company name where it is a change of name; the signature in the right name for the category; two witnesses complete with signature, full name, address and mobile number |
| 2. The affidavit or undertaking | The same names and address as the proforma, word for word, with wording matching the category. On Rs 100 non-judicial stamp paper as our safe default |
| 3. The original newspaper | The original paper, not a cutting; the paper name and date of publication visible; both names carried; the father or husband name and residential address; dated within the last year |
| 4. Photographs, identity proof and any category paper | Two self attested passport photographs; self attested identity and address proof matching the proforma address; both witnesses proofs; and, in a public notice file, the attested photocopy of the connected document carrying the error |
| 5. The CD, its certificate and the BharatKosh receipt | MS Word, without the witness portion, with the name typed in place of the signature; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt |
The posting detail is on the sending the file to Delhi page, the change of name wording on the proforma format page and the public notice wording on the public notice proforma page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.
What Changing a Gender Entry and Name Costs in Jharkhand
This is the section where we have least to sell, and we would rather set that out honestly than pad it.
| Item | What we can and cannot tell you |
|---|---|
| The certificate of identity | This is a Government process in your own district, and we print no figure for it, because the procedure and any charge are set by the district administration and are exactly what step one asks you to confirm in writing. Ask that office, not us |
| Any medical documentation the procedure requires | We cannot quote this and will not try. It depends on the procedure being followed and on your own circumstances, and it is not something a documentation desk should be pricing |
| The Aadhaar update | A small Government charge per attempt at the centre, and the update may take up to 90 days. The charge is per attempt and is not refunded if the update is rejected, which is the practical argument for getting the papers right first |
| The gazette charge, if a name change genuinely needs one | Paid only through BharatKosh, revised each financial year and non refundable. Read the amount on the portal on the day. Our cost page keeps the working figures |
| The newspaper advertisement, on the name side only | Varies by paper, edition and number of lines, so we print no figure. Keep the wording short, because you pay by the space |
| Our charge | Quoted on the call, after we have seen your papers, and never before we have told you whether this is one job or two and whether you need us at all |
| The part that is free and matters most | The written question to your District Magistrate's office. It costs a sheet of paper and it decides the whole route |
Myths About Changing a Gender Entry in Documents in Jharkhand
| What people are told | What is actually so |
|---|---|
| A gazette notification changes the gender entry | It is not the instrument. The Act provides for a certificate of identity issued by the District Magistrate, and states that the gender "shall be recorded in all official documents in accordance with certificate issued." |
| The gender and the name are one change | They are two jobs with two instruments. One may apply to you without the other, and a desk quoting a single price without asking has not understood your case |
| You have to go to Delhi or to a State capital office | The application goes to your own District Magistrate. Ranchi, Dumka, Chaibasa, wherever you live |
| The Aadhaar needs a gazette for a gender update | Its published procedure names a certificate, either a medical certificate with photograph or, where transgender status is recorded, "a certificate issued by the Central/State Govt as POI document." No gazette |
| A parent cannot apply for a child | The Act says the opposite. Where a minor is concerned "such application shall be made by a parent or guardian." |
| Once the certificate exists, every office updates automatically | No record updates itself. Each office amends its own register on a written request, and you should take a dated acknowledgement every time |
| You can keep updating the Aadhaar until it is right | Both entries are limited. The name "can be updated twice in a lifetime", and the same procedure refers to "restrictions on number of Gender update". Get it right once |
| The law on this has not changed for years | It changed in 2026, and the amendment has been challenged. That is precisely why step one on this page is a written question to your own district office |
| An office refusing means you need a stronger paper | Usually not. Take the certificate and the printed provision, and ask in writing which provision adds the requirement. Buying something else rarely answers a checklist problem |
| Any consultant can handle this end to end | A documentation desk cannot issue a certificate and should not be pricing medical steps. What a desk can honestly do is the paperwork, the written requests and the name side. Be wary of anyone claiming more |
Key Terms in a Gender Entry Change in Documents
| Term | What it means in practice |
|---|---|
| Certificate of identity | The document the Act provides for, issued by the District Magistrate. The instrument the rest of the job rests on |
| District Magistrate | The officer the Act names to receive the application and issue the certificate. Your own district, not a central office |
| Recorded in all official documents | The Act's own words for what follows from the certificate. A statutory entitlement, not a request |
| Revised certificate | What the Act provides for where a person undergoes surgery, issued by the District Magistrate indicating the change in gender |
| First name | The entitlement the Act attaches to the certificate, to change the first name in the birth certificate and other identity documents. The first name expressly |
| Authority | The term the 2026 amendment introduces for a medical board headed by a Chief Medical Officer or Deputy Chief Medical Officer, appointed by the appropriate Government |
| Proof of identity document | What the Aadhaar procedure calls the document supporting an update. For a gender update it names a certificate, not a gazette |
| Restrictions on number of updates | The Aadhaar procedure's own phrase. The name is twice in a lifetime, and gender updates are also restricted |
| Dated acknowledgement | A receipt with a date from the office you gave a request to. The foundation of anything you can do if it stalls |
| Correction against change | A wrong entry nobody ever changed is a correction against the office's own record, and needs none of the route on this page |
| Gazette notification | Publication in the Gazette of India, Part IV. Relevant to a first name change where a record asks for it, and not the instrument for a gender entry |
| Commencement | When an Act or amendment actually comes into force, which can be later than when it was passed. Exactly the thing to confirm with your district office |
Document Help Across Jharkhand for a Gender Entry or Name Change
The certificate comes from your own District Magistrate, so this is a district by district subject in a way most of this website is not. What we do is the documentation around it, and we are clear about where our work stops. We read your records against each other, tell you whether this is one job or two, help you draft the written question to your district office, prepare written requests to each record holder quoting the provision, handle the name side where a record genuinely asks for a gazette, and keep everything organised for the years in which you will be asked for it again. We do not issue certificates, we do not advise on medical steps, and where the certificate is the whole answer we will say so and charge you nothing. We work across Ranchi, Jamshedpur, Dumka, Chaibasa and every other district, on scans over WhatsApp.
District pages are linked from the services page.
Send your papers and tell us which entries are changing
Tell us first which entries are actually changing, the gender, the name, or both, because that decides whether this is one job or two and whether any part of it is ours at all. Then send scans of your Aadhaar, the record that carries the entry you need corrected, and any certificate or acknowledgement you already hold. If you have already written to your District Magistrate's office, send us their reply and we will work from it rather than from our own assumptions. Our first reply tells you whether the certificate route alone answers your situation, whether a name change is a separate job, and what to ask your district office. If nothing here needs us, we will tell you that and charge nothing. Details on the contact page.

People Also Ask About Changing a Gender Entry in Documents
| The question | The answer, with its source |
|---|---|
| Is the transgender certificate application free? | Yes. The National Portal for Transgender Persons answers it in one line: "No. The application process is free of cost." |
| How many days does the certificate take? | The portal states processing depends on the district's verification "up to a maximum of 30 Days." That is an outer limit, not a promise about your file |
| Can I change my gender in Aadhaar online? | No. The Authority's own material limits online updating to the address field. A gender update is done at an enrolment centre, whatever other websites tell you |
| What if my Aadhaar gender update is rejected for exceeding the limit? | The Authority publishes an exception route. Its answer names the documents to send as "EID slip of latest enrolment, alongwith Medical Certificate/Transgender id card" and directs the resident to 1947 or the Authority by email. Your transgender identity card is expressly named, which is why the certificate route matters before the Aadhaar one |
| Do I need surgery to change my gender entry? | The sources do not speak with one voice and we will not pretend they do. The national portal's definition covers a person "whether or not such person has undergone Sex Reassignment Surgery". The Act as amended from 25 May 2026 routes the certificate through a medical board. Ask your district office what it is applying |
| Is a gazette notification needed for a gender entry? | Not as the instrument. The Act ties the record to the certificate. A gazette belongs to a change of first name, which the Act deals with separately |
| Is my certificate from before the amendment still valid? | We are not going to answer that from a news report. It is exactly the question to put in writing to your District Magistrate's office, and to keep the reply. Anybody answering it confidently on a website is guessing about your document |
| Can a parent apply for a child? | Yes. Where a minor is concerned the Act provides that "such application shall be made by a parent or guardian" of the child |
| Which office issues it, and do I go to Delhi? | Your own District Magistrate. Ranchi, Dhanbad, Jamshedpur, Bokaro, Dumka, wherever you live. Nothing in this route goes to Delhi, unlike the gazette route on the rest of this website |

Changing a Gender Entry in Documents, in Nine Lines
| The short version | Why it matters |
|---|---|
| The gender entry and the name are two separate jobs | Two instruments, and you may need only one |
| The instrument is a certificate from the District Magistrate | Your own district, not Delhi and not a private desk |
| The Act ties the record to that certificate | It is a statutory entitlement, not a request |
| The Aadhaar procedure names a certificate too | No gazette notification for a gender update |
| A parent or guardian applies for a minor | The Act says shall, not may |
| Both Aadhaar entries are limited in number | So settle everything and do it once |
| The Act was amended in 2026 and challenged | Ask your district office what applies today |
| A refusal is answered in writing, not by buying more | Print the provision and ask which one adds the requirement |
| A wrongly typed entry is a correction, not this route | And it usually needs no published paper at all |
Not Sure Whether Your Case Is One Change or Two?
Send the records and tell us which entries are changing. Our first reply tells you which route applies, what to ask your district office, and whether any of it needs us at all.
