A court adoption order already changes the name • A fresh birth certificate follows it • The gazette is for the other route

Name Change After Adoption in Jharkhand

Most families are sold a gazette file they do not need. If the adoption went through a court and an adoption order was issued, the law has already done the work. The Juvenile Justice Act says the child becomes the child of the adoptive parents as if the child had been born to them, for all purposes, and the Adoption Regulations make the agency apply for a fresh birth certificate carrying the adoptive parents as parents. That certificate is the proof, not a gazette notification. The route that does sometimes need a gazette is the other one, a Hindu adoption recorded only in a registered deed with no court order behind it. Find out which one you are in before you pay anybody.

2Adoption routes, and they behave differently
0Gazette notices a court adoption needs
5Days the agency has to apply for the certificate
63The section that does the work for you
Quick answer

There are two adoption routes in India and they do not behave the same way, so the first job is to find out which one your family used. If the adoption was completed through a court, whether through a Specialised Adoption Agency and the Central Adoption Resource Authority or through a district court petition, you are holding an adoption order, and that order has already done the work. Section 63 of the Juvenile Justice Act 2015 says a child in respect of whom an adoption order is issued by the court shall become the child of the adoptive parents, and the adoptive parents shall become the parents of the child as if the child had been born to the adoptive parents, for all purposes, including intestacy. The Adoption Regulations 2022 then carry that into the record: Regulation 13(9) requires the Specialised Adoption Agency to apply to the birth certificate issuing authority within five days from the date of issuance of the adoption order, for a birth certificate with the name of adoptive parents as parents, and date of birth as recorded in the adoption order. So the proof of the child's new name and new parentage is a fresh birth certificate, issued by the registrar on the strength of the court order. A gazette adds nothing to that. The route where a gazette can genuinely come in is the second one, a Hindu adoption under the Hindu Adoptions and Maintenance Act 1956 recorded only in a registered adoption deed with no court order, because there is no order for a registrar to act on and nothing that automatically rewrites the birth record. Before you spend anything, look at what your family actually holds. An order and a deed are two different documents with two different consequences.

Two Adoption Routes in India, and Why the Route Decides Everything

Name change after adoption in Jharkhand with a new birth certificate from the adoption order
An adoption order is not a step towards the name change. It is the name change.

Almost every wrong quotation we see for an adopted child comes from one mistake, which is treating both routes as though they were the same file. They are not. One ends in a court order that a registrar must act on. The other ends in a deed that no office is obliged to do anything with.

The two adoption routes in India and what each one produces
RouteWhat you hold at the endWhat it does for the name
Court adoption under the Juvenile Justice Act 2015, through a Specialised Adoption Agency and the Central Adoption Resource Authority, or a district court petitionAn adoption order from the court or the District MagistrateSection 63 makes the child the adoptive parents' child for all purposes. Regulation 13(9) then gets a fresh birth certificate with the adoptive parents as parents. No gazette
Hindu adoption under the Hindu Adoptions and Maintenance Act 1956, recorded in a registered adoption deedA registered adoption deed signed by the person giving and the person taking the childSection 12 deems the child the adoptive parents' child, but no court order exists for a registrar to act on. This is the route where a gazette is genuinely used
An adoption spoken of in the family but never written downNothing that any office can readNothing. This has to be put on a legal footing first, before any record is touched
What Section 63 actually says. That a child in respect of whom an adoption order is issued by the court, shall become the child of the adoptive parents, and the adoptive parents shall become the parents of the child as if the child had been born to the adoptive parents, for all purposes, including intestacy, from the date the order takes effect. Read that sentence twice. It is not a step towards a name change. It is a change of parentage decided by a court, and a gazette notification is a weaker document than a court order, not a stronger one.
Where the second route bites. Under the Hindu Adoptions and Maintenance Act, Section 16 gives a registered adoption deed a presumption: where a registered document purporting to record an adoption, signed by the person giving and the person taking the child, is produced before a court, the court shall presume that the adoption has been made in compliance with the Act unless and until it is disproved. That presumption works in a court. It does not, by itself, make a municipal registrar reissue a birth certificate or make a school rewrite its register. That gap is the real reason a gazette is sometimes used on this route, and nobody selling you one usually explains it that way.

If you are not sure which route your family used, the wider decision between a correction, an affidavit and a published notice is set out on our correction against change of name page, and the general minor position on minor name change in Jharkhand.

The Fresh Birth Certificate After an Adoption Order, and Who Applies For It

This is the part nobody explains, and it is the whole answer for families who adopted through a court. The new record is not created by a gazette, an affidavit or a newspaper notice. It is created by the registrar, acting on the adoption order.

How the adopted child's fresh birth certificate is obtained after a court adoption order
QuestionThe position
Who appliesThe Specialised Adoption Agency applies to the birth certificate issuing authority. Adoptive parents can also apply
How soonRegulation 13(9) says within five days from the date of issuance of the adoption order, for an in-country adoption
What the certificate carriesThe name of adoptive parents as parents, and date of birth as recorded in the adoption order
Inter-country adoptionRegulation 19(5) says the same thing in the same words for an adoption going abroad
Who issues itThe local registrar of births and deaths, which in Jharkhand means the Municipal Corporation, Nagar Parishad, Nagar Panchayat or block registrar for the place concerned
The sentence worth quoting at a counter. Regulation 13(9) of the Adoption Regulations 2022: the Specialised Adoption Agency shall apply to the birth certificate issuing Authority for obtaining the birth certificate of the child within five days from the date of issuance of adoption order, with the name of adoptive parents as parents, and date of birth as recorded in the adoption order. If a clerk tells an adoptive parent that a gazette is needed first, this is the regulation that says otherwise, and the Central Adoption Resource Authority publishes its own page on the birth certificate issuing authority as well.
If the agency never applied. It happens, especially with older adoptions. The five day duty sits on the agency, and years later there may be no fresh certificate anywhere. That does not close the door. Go to the registrar yourself with the certified copy of the adoption order and ask in writing for the certificate to be issued on the strength of it. Put the request in writing, keep a stamped copy, and be prepared for it to take time. What you are asking for is the thing the regulation always intended you to have.
One thing to check on the new certificate the day you get it. The spelling of the child's name and the spelling of both adoptive parents' names, letter by letter, and the date of birth against the order. A mistake caught at the counter is a five minute conversation. The same mistake found at a passport appointment eleven years later is a file. The general correction route for a birth record is on our name change in birth certificate page.

The Child's Own Name After Adoption, and When a Separate Name Change Is Needed

Here we will be straight with you, because the law is clearer about the parents' names than about the child's first name, and most pages on this subject blur the two together on purpose.

What the Regulations Do and Do Not Say

1

Parents' names, clearly covered

The regulation says the certificate carries the name of adoptive parents as parents. That part is not in doubt and it is the part most families actually need.

2

Date of birth, clearly covered

As recorded in the adoption order. The order is the source, so a wrong date is corrected by going back to the order, not by a separate file.

3

The child's own first name, not spelt out

The regulations do not set out a procedure for changing it. In practice the name the adoptive parents give is carried in the adoption order itself and flows from there.

So read your adoption order before anything else. Whatever name it records is the name the registrar will write, because the regulation makes the order the source. If the order already carries the name you want the child to have, there is nothing further to change and anybody quoting you for a gazette is quoting you for a document you do not need. If the order carries a different name, that is the moment to know it, because the fix is different and much smaller than a gazette file.
When a separate name change is needed after an adoption and when it is not
Your situationWhat is actually needed
Court adoption, and the adoption order carries the name you wantNothing more. Get the fresh birth certificate and start using it. No affidavit, no newspaper, no gazette
Court adoption, but the family wants to change the child's first name laterThis is now an ordinary minor name change, decided by the guardian, and it follows the minor route, not an adoption route
Court adoption, and the order or certificate has a spelling mistakeA correction against the order, at the issuing office. Cheaper and faster than any change of name
Hindu adoption on a registered deed only, no court orderThis is where affidavit, newspaper and gazette genuinely come into the picture, because no order exists for a registrar to act on
Adoption never recorded in writing at allPut the adoption itself on a legal footing first. No paperwork on a name will hold without that
A later change is a minor file, not an adoption file. If your child is already adopted, already has the fresh birth certificate, and you now simply want a different first name, then the adoption is finished business and you are in the ordinary minor route: the guardian signs and the child signs nothing. That is set out on our name change affidavit for a minor page. Do not let anybody price it as an adoption matter.

The Order to Settle an Adopted Child's Name and Records in Jharkhand

The first two steps cost nothing and they are the two that decide whether anything else is needed at all.

1

Find the adoption paper and read the name on it

An adoption order or a registered deed. Which one you hold decides the entire route, and the name written on it decides whether there is anything left to change.

2

Get a certified copy of the order

From the court that passed it. Every office ahead of you will want to see a certified copy, and originals should never leave your hands.

3

Ask the agency whether the certificate was applied for

The duty was theirs, within five days of the order. If it was never done, you can apply to the registrar yourself on the order.

4

Collect the fresh birth certificate

Adoptive parents as parents, date of birth as in the order. Check every spelling at the counter, before you leave.

5

Correct the school admission register next

In writing to the head of the institution, with the new birth certificate. The register is what the board prints from later.

6

Then the Aadhaar, never before

Boards and offices match the Aadhaar against the school record. Settle the record first or you create the mismatch you are trying to remove.

7

Decide about the caste or ST certificate separately

It is a different application with a different officer, and it is the question most likely to be handled badly. Read that section below.

8

Build a gazette file only on the deed route

And only after somebody has read the deed. On the court route this step does not exist at all.

9

Keep one sealed folder for the child

Order, fresh certificate, register page copy. Hand it over when they are an adult, with an explanation, not as a surprise.

The order that goes wrong most often. Parents update the Aadhaar first because it is the quickest counter to reach, then find the school register still holds the old entry and the two no longer agree. Work outwards from the birth certificate, then the school admission register, then the Aadhaar, and nothing contradicts anything. The school side is set out in full on our child name change in school records page.

The Caste and ST Certificate Question for an Adopted Child in Jharkhand

In Jharkhand this is not a side question. A Scheduled Tribe or Scheduled Caste certificate decides school admissions, scholarships, recruitment and land questions, and adoptive parents ask us about it more often than they ask about the name. We will give you the honest position rather than a comfortable one.

What a High Court held in January 2026. In Mrs Geeta Dattatray Achari against State of Maharashtra, a Division Bench of the Bombay High Court, Justices M S Karnik and S M Modak, held on 29 January 2026 that an adopted child whose biological parents are unknown must be given the caste status of the adoptive parents where the adoption is validly established by a court order. The child had been abandoned at birth, adopted through a district court in 2014, and given a certificate in the adoptive mother's category. An anonymous complaint led to it being cancelled. The High Court restored it, reasoning that to hold otherwise would undermine the legal effect of the adoption and leave the child's status uncertain.
Now the caveats, and they matter more than the headline. We have read this from news reports of the judgment, not the certified copy, so treat the wording above as a report and not as a quotation from the order. Three things limit it. First, the child's biological parents were unknown, and that fact sits at the centre of the reasoning, so a family in Jharkhand that adopted a relative's child whose parents and community are perfectly well known is not in the same situation. Second, it is a decision of the Bombay High Court, which is persuasive in Jharkhand, not binding on it. Third, a caste certificate is issued and scrutinised by officers who decide on the facts of the individual case, and a High Court decision from another state does not remove that scrutiny.
How the caste or ST certificate question is approached for an adopted child
SituationHow we would approach it
Child abandoned at birth, biological parents unknown, court adoption order heldThe strongest case for the adoptive parents' status, and the situation the January 2026 decision was actually about. Apply with the adoption order and the fresh birth certificate
Relative's child adopted, biological parents and community knownA different and harder question, and one where we will not promise you an outcome. Be prepared for the officer to look at the child's origin, and take proper advice before applying
Certificate already issued and then cancelled after a complaintThis is litigation, not documentation. It needs an advocate. Our part is making sure the underlying records are clean and consistent before anybody argues about them
Applying while the records still disagree with each otherDo not. Settle the birth certificate and the school register first. A scrutiny that finds two different names or two different parentages will go badly whatever the legal position
We are a documentation consultancy and not advocates. We will prepare and align your records, and we will tell you plainly what each paper does. On a contested caste or Scheduled Tribe claim for an adopted child, take proper legal advice. Anybody who guarantees you a Scheduled Tribe certificate for an adopted child in exchange for a fee is selling you something they cannot deliver. The wider position on tribal surname records in Jharkhand is on our tribal surname spelling correction page.

Central Gazette Process for an Adopted Child From Jharkhand, Where the Deed Route Needs One

Read this before the rest of this section. If your family holds a court adoption order, you do not need any of what follows. The order plus the fresh birth certificate under Regulation 13(9) is the stronger route and it is already yours. The process below matters on the registered adoption deed route, where no court order exists for a registrar to act on, and in the narrower case where adoptive parents want to change the child's first name years later. We print it in full so you can see exactly what you are being quoted for, and recognise it at once if somebody tries to sell it to you while a court order is sitting in your file.

No district in Jharkhand has a gazette counter, so the file goes from Ranchi, Jamshedpur, Dhanbad, Bokaro, Hazaribagh, Deoghar or anywhere else in the state to the Department of Publication, Civil Lines, Delhi 110054, and the notice publishes in Part IV of the Gazette of India. As reported in July 2025 the Finance Department stopped personal name change notifications from the Jharkhand Government Press with immediate effect, so there is no state alternative to fall back on.

The Eight Steps of an Adopted Child's Name Change File Sent From Jharkhand

1

Settle the final name first

Write it out letter by letter, with the spacing you want, and then use exactly that in every paper. A corrigendum after publication is a second fee and a second wait.

2

Pick the category, then its proforma

Change of name for a minor, which has its own guidelines and its own Rs 1,700 printed charge, or a public notice where the child's name was simply written wrongly. Twelve categories exist and only one is yours. An adoption is not itself one of the twelve.

3

Type the proforma in duplicate

Two originals. On a minor's file the Guardian signs, never the child, with two witnesses giving signature, full name, address and mobile number on both copies. The form asks for the parent's employment and the child's age.

4

Get the affidavit attested at the right level

A notary for the ordinary change of name, and a First Class Magistrate of the concerned area where the different surname guidelines apply. This is the step that catches people out.

5

Publish and keep the original paper

One of the daily local leading newspapers, carrying the child's old name in full, the new name, the parent's name and the address. The whole original paper goes in the file.

6

Pay only through BharatKosh

The Non Tax Receipt Portal and nowhere else since October 2018. Select the Department of Publication by name, read the amount the portal shows on the day, pay in your own name and print the e-receipt.

7

Check every date, then post it yourself

Nothing in the file older than one year. Personally or by post or courier only, never through an agent or advocate. Photocopy everything first, because nothing sent in comes back.

8

Read the notice, then download it

Check both of the child's names letter by letter the day it publishes, note the page and issue number, and download the e-Gazette copy of that Part IV issue.

The Five Papers in the File, and What Is Checked in Each

The five papers of a Central Gazette minor's name change file and what the Department checks in each
The paperWhat is checked in it, clause by clause
1. The proforma, in duplicateThat it is the right category's format; the existing full name exactly as your documents carry it, surname included; the child's new full name exactly as you settled it; the father's or husband's name; the full address with pin code; the signature in the old name; two witnesses complete with signature, full name, address and mobile number
2. The affidavit or undertakingSigned by the parent applying; the same names and address as the proforma, word for word; attested at the level the category asks for, which is a First Class Magistrate for the adopting a different surname route; on Rs 100 non-judicial stamp paper as our safe default
3. The original newspaperThe original paper, not a cutting; the paper's name and date of publication visible; both of the child's names carried; the same spelling as the proforma; dated within the last year
4. Photographs, identity proof and any category paperTwo self attested passport photographs of each applicant and the child, which the minor guidelines ask for specifically; identity and address proof matching the proforma address; both witnesses' proofs; and whatever the category itself demands, such as a decree or a no objection certificate where the maiden surname requirement applies
5. The CD, its certificate and the BharatKosh receiptMS Word, without the witness portion, with the name of the Guardian typed in place of the signature, which is where a minor file differs from an adult one; the certificate that the hard copy and the soft copy are the same; the forwarding letter to the Controller of Publication with a telephone number and email; the e-receipt
The proforma is where files are lost, and there are twelve to choose from. A maiden surname file typed on the ordinary change of name form, or a change of name typed on a surname form, comes back. The Government charge already paid is not refunded, because BharatKosh payments are non-refundable. You then have six months to make good a shortcoming the Department points out, after which a fresh application with all new documents is required.
What to select on BharatKosh, field by field. Pay to the Department of Publication under the Ministry of Housing and Urban Affairs, and pick the Ministry, the Pay and Accounts Office and the Drawing and Disbursing Officer by their names in the dropdown, never by a code copied off a website. The codes printed for this office on different websites do not agree with each other, and money paid into the wrong head cannot be traced to your file. Read the amount on the portal on the day you pay, because it is revised each financial year.
How to read the published notice before you rely on it. Open the e-Gazette copy and check five things: that it says Part IV; the date of publication; your old full name exactly as your documents carry it, with the surname spelt as it appears there; the child's new name, letter by letter; and the father's or husband's name and address. Then note the page number and the issue number, because that is what an office will quote back to you at verification.

The posting detail is on the sending the file to Delhi page, the wording on the proforma format page, the charge by category on the fee and undertaking page, the reasons files come back on the rejection reasons page, and the download on the download page.

What a Name Change After Adoption Costs in Jharkhand

Cost and time for settling an adopted child's name and records in Jharkhand
ItemCostTime
Where a court adoption order existsNo gazette charge at all. What you pay is the court's charge for a certified copy of the order and whatever the registrar charges for the fresh birth certificate. This is the cheapest route on this page by a wide marginThe regulation puts the certificate application at five days from the order. In practice allow a few weeks
Where only a registered adoption deed existsThe registration charge on the deed, and then the gazette line items below if a published notice is genuinely needed. Have somebody read the deed before you pay for anything furtherSeveral weeks once the file is posted
Government printing chargeThe minor guidelines print Rs 1,700 for a change of name of a minor with effect from 01.04.2016 to 31.03.2017. For comparison the adult guidelines print Rs 1,100 for the same year, and Rs 3,500 for an Indian living abroad. Every category's guidelines add that the charge varies each financial year and from case to case, so treat these as the order of the amount. What BharatKosh shows on the payment screen the day you pay is the figure that countsPart IV publishes weekly, so allow several weeks from posting
AffidavitRs 100 non-judicial stamp paper plus the attestation, signed by the guardian. A notary is enough for an ordinary change of name. A First Class Magistrate is only for the adopting a different surname routeNotary the same day; a magistrate needs a planned court visit
NewspaperPaid to the paper, charged by lengthSame week
Post or courier to DelhiSent in your own name from any district, and keep the receiptA few days each way
Updating the records afterwardsAadhaar charges a fee per attempt with no refund, and the other offices have their own small chargesSeveral weeks across all of them
Our chargeQuoted on your papers before you pay anything, and confirmed in writing. We print no service price on any page of this site
Do not trust a figure printed on any website, including this one, on the day you pay. The Department's own guidelines say the printing charge varies each financial year and from case to case, so the figures above are what the published guidelines show for 2016 to 2017 and are given so you know the order of the amount, not the amount. What BharatKosh shows when you reach the payment screen is the one that counts. Read it there and pay that.

The honest total, where a gazette is genuinely needed on the deed route, is the Government charge, the affidavit, the newspaper and the postage, and then several weeks of waiting for Part IV. But the cost that matters most on this page is the one nobody should pay at all: a full gazette file sold to a family that already holds a court adoption order. That family needed a certified copy and a trip to the registrar. Our corrigendum page explains what a second file involves, and our name change cost page sets out the line items in full.

Myths Adoptive Parents Are Sold About a Name Change

Common beliefs about changing an adopted child's name and what is actually correct
What adoptive parents are toldWhat is actually so
Every adoption needs a gazette notificationNo. Where a court adoption order exists, Section 63 already makes the child the adoptive parents' child for all purposes, and the Adoption Regulations get a fresh birth certificate with the adoptive parents as parents. A gazette adds nothing to a court order
A gazette is stronger proof than the adoption orderThe opposite. A gazette is a published notice. An adoption order is a court order that changes the child's legal parentage. No office treats the notice as the stronger document
The adoptive parents have to apply for the new birth certificate themselvesThe regulation puts that duty on the Specialised Adoption Agency, within five days of the order. Ask them first. Parents can apply too, and often have to when an old adoption was never followed up
The new certificate shows the child was adoptedIt is issued with the name of adoptive parents as parents and the date of birth from the order. It is the child's birth certificate, not an adoption record
A registered adoption deed does the same job as an orderIt does not. Section 16 gives a registered deed a presumption in court, which is useful, but it is not an order a registrar must act on. This is the exact gap the gazette route fills
Do the Aadhaar first, it is quickestThe wrong order, as always. Birth certificate, then school admission register, then Aadhaar. Going the other way creates the mismatch you were trying to remove
The school will update the register on a verbal requestHand in a written application in two copies with the fresh birth certificate attached, and keep one stamped as received. A verbal request leaves no record to escalate with
A Scheduled Tribe certificate follows automatically from the adoptionIt does not follow automatically anywhere. A High Court has held for the adoptive parents' status where the biological parents were unknown, which is a narrower situation than most Jharkhand adoptions. Take proper legal advice
The question that ends most wrong quotations. Ask whoever is quoting you: which document in my file are you saying is not enough, and what will the gazette do that it does not do? If you hold a court adoption order and the answer is vague, the quotation came before the diagnosis. We would rather lose that work than take it.

Key Terms in an Adoption Name Change

Key terms used when changing an adopted child's name and records
TermWhat it means in practice
Adoption orderThe order of the court or the District Magistrate completing the adoption. The single most valuable paper in this whole file, and the source for the child's date of birth and the parents' names
Section 63Of the Juvenile Justice Act 2015. The section that makes the child the adoptive parents' child as if born to them, for all purposes, from the date the order takes effect
Regulation 13(9)Of the Adoption Regulations 2022. The rule that sends the agency to the registrar within five days of the order for the fresh birth certificate
Regulation 19(5)The same rule in the same words for an inter-country adoption
Specialised Adoption AgencyThe recognised agency that handles the adoption and carries the duty to apply for the certificate. Your first call when no fresh certificate exists
Central Adoption Resource AuthorityThe national body under the Ministry of Women and Child Development that runs the adoption system and publishes the Regulations
Registered adoption deedA Hindu adoption recorded and registered in writing, signed by the person giving and the person taking the child. Strong in a court, weak at a counter
Section 16, Hindu Adoptions and Maintenance ActThe presumption that a registered adoption document is valid unless and until it is disproved. A presumption in court, not an instruction to a registrar
Birth certificate issuing authorityThe local registrar of births and deaths. In Jharkhand the Municipal Corporation, Nagar Parishad, Nagar Panchayat or block registrar for the place concerned
Certified copyA copy issued by the court itself, which is what every office will want. Never hand over an original order to anybody
Admission registerThe school's own record in which every student's name is entered on admission. What a board prints from, so it is corrected before any certificate is issued
GuardianOn any minor's file, the person who signs. The child signs nothing, whatever their age

Name Change After Adoption in Jharkhand: Frequently Asked Questions

Do we need a gazette after adopting a child?+
If the adoption was completed through a court and you hold an adoption order, no. Section 63 of the Juvenile Justice Act 2015 already makes the child the adoptive parents' child as if born to them, for all purposes, and the Adoption Regulations provide for a fresh birth certificate with the adoptive parents as parents. A gazette is a published notice and it adds nothing to a court order. The route where a gazette is genuinely used is a Hindu adoption recorded only in a registered deed, with no order behind it.
What exactly does the new birth certificate say?+
It is issued with the name of adoptive parents as parents, and date of birth as recorded in the adoption order, in the words of Regulation 13(9) of the Adoption Regulations 2022. It is the child's birth certificate, issued by the local registrar. Check every spelling and the date at the counter before you leave, because a mistake caught then is a conversation and the same mistake found years later is a file.
Who applies for that certificate, and how soon?+
The regulation puts the duty on the Specialised Adoption Agency, which shall apply to the birth certificate issuing authority within five days from the date of issuance of the adoption order. Adoptive parents can apply as well. Ask the agency first. If the adoption was years ago and nobody ever did it, go to the registrar yourself with a certified copy of the order and ask in writing.
Can we give the child a completely new first name?+
In practice the name the adoptive parents give is carried in the adoption order itself, and the registrar writes what the order records. So read your order first. We will be straight with you: the Regulations set out the parents' names and the date of birth clearly, and do not spell out a separate procedure for changing the child's first name. If you want a different first name later, after the certificate exists, that is an ordinary minor name change decided by the guardian, not an adoption matter, and it should not be priced as one.
We adopted under Hindu law with a registered deed. What is different?+
Section 12 of the Hindu Adoptions and Maintenance Act 1956 deems the child to be the adoptive parents' child for all purposes, and Section 16 says a court shall presume a registered adoption document valid unless and until it is disproved. That is strong in a court. What you do not have is a court order for a registrar to act on, so no fresh birth certificate follows automatically. This is the route where an affidavit, a newspaper notice and a gazette genuinely have a job to do.
What if the adoption was never written down at all?+
Then no paperwork on the name will hold, because there is nothing for any office to read. The adoption itself has to be put on a legal footing first. That is a matter for an advocate, not a documentation desk, and anybody who offers to fix it with an affidavit is not telling you the truth about what an affidavit is.
In what order do we update the child's records?+
Birth certificate, then the school admission register, then the Aadhaar. Never the Aadhaar first. Boards and offices match the Aadhaar against the school record, so starting there creates the mismatch you are trying to remove. The school side is on our page about a child's school records, including the correction window that closes before admit cards are released.
Will the adopted child get our caste or Scheduled Tribe status?+
It does not follow automatically, and in Jharkhand this question deserves proper care. A Division Bench of the Bombay High Court held on 29 January 2026 that a child whose biological parents are unknown must be given the adoptive parents' caste status where the adoption is validly established. We have that from news reports, not the certified copy. Note the limits: the biological parents being unknown is central to it, it is another state's High Court, and a scrutiny officer still decides on the facts. Take legal advice before applying.
We adopted a relative's child and everyone knows the family. Does that change things?+
For the name and the records, no. What matters is still whether you hold an order or a deed. For a caste or Scheduled Tribe claim, yes, it changes things a great deal, because the reasoning in the January 2026 decision turned on the biological parents being unknown. We will not promise you an outcome there, and we would rather say so now than after you have paid.
Does the school need to know the child is adopted?+
What the school needs is a written application with the fresh birth certificate attached, so the admission register matches the record the board will eventually print from. The certificate carries the adoptive parents as parents. Hand in two copies, keep one stamped as received, and ask in the same letter for an attested copy of the corrected register page.
What should we keep, and for how long?+
A certified copy of the adoption order, the fresh birth certificate, the attested copy of the school register page, and any published notice. Keep them in one folder, permanently. Hand it to your child when they are an adult, with an explanation rather than as a surprise. An adult who can explain their own paperwork in one sentence at a verification is in a completely different position from one meeting it for the first time at a job interview.
What does the whole thing cost if we hold a court order?+
The court's charge for a certified copy of the order, and whatever the registrar charges for the fresh certificate. That is the cheapest route on this page by a wide margin, and there is no gazette charge at all. We do not print school, court or registrar charges here because they vary and we have not verified them for every office. What we will do is tell you the total for your own case before you pay anything.

Who wrote and checked this page

Written and maintained by the Jharkhandnamechange.com documentation desk, led by founder Vipin Chauhan, B.Tech LL.B, with 5+ years filing with the Department of Publication. What this page says about the effect of a court adoption comes from Section 63 of the Juvenile Justice (Care and Protection of Children) Act, 2015, that a child in respect of whom an adoption order is issued by the court shall become the child of the adoptive parents, and the adoptive parents shall become the parents of the child as if the child had been born to the adoptive parents, for all purposes, including intestacy. What it says about the fresh birth certificate comes from the Adoption Regulations, 2022 published by the Central Adoption Resource Authority: Regulation 13(9) for in-country adoption, that the Specialised Adoption Agency shall apply to the birth certificate issuing Authority within five days from the date of issuance of adoption order, with the name of adoptive parents as parents, and date of birth as recorded in the adoption order, and Regulation 19(5) in the same words for inter-country adoption. The deed route is stated from the Hindu Adoptions and Maintenance Act, 1956, Section 12 on the effects of adoption and Section 16, that where a registered document purporting to record an adoption and signed by the person giving and the person taking the child is produced before a court, the court shall presume that the adoption has been made in compliance with the Act unless and until it is disproved. The caste point is reported from news reports of a Bombay High Court judgment of 29 January 2026, a Division Bench of Justices M S Karnik and S M Modak, and we have not read the certified copy, which is why we set out its limits on this page rather than presenting it as settled law for Jharkhand. We are a documentation consultancy and not advocates, and a contested caste or Scheduled Tribe claim needs legal advice, not documentation help. We do not print court, registrar or school charges, which vary by office. Who we are is on the about page.

Adoption and a Child's Name in Eight Lines

The short version

  • Find out first whether you hold a court adoption order or a registered deed.
  • An order makes the child yours for all purposes under Section 63.
  • The agency applies for a fresh birth certificate within five days of the order.
  • That certificate carries the adoptive parents as parents and needs no gazette.
  • If the agency never applied, go to the registrar yourself with a certified copy.
  • A deed route has no order for a registrar to act on, so a gazette can apply there.
  • Birth certificate first, then the school register, then the Aadhaar. Never the reverse.
  • A caste or Scheduled Tribe claim is a separate question. Take legal advice on it.

Send us the adoption paper and we will tell you in one reply whether you need anything at all.

The order or the deed, and the child's birth certificate if one exists. We will name the route, say what is missing, and give you the total before you pay anything.
